Please find attached a statement on behalf of the Department of Infrastructure's Planning and Building Control Division in respect of the above planning application.
Under 10.(1)(b) of the Town and Country Planning (Development Procedure) Order 2005, as the proposed development includes land within the Department of Infrastructure could be said to have a vested interest in the planning application cannot be determined by the Planning and Building Control Division. As you will be aware in accordance with the relevant legislation such planning applications are referred to and determined by the Council of Ministers. In these instances a Planning Inspector is duly appointed to assess the planning application and report their recommendations to the Council of Ministers.
Given the above, the Planning and Building Control Division's role in the determination of the planning application is understood to be only to set out factual background to the proposal, advise on relevant planning policy considerations and provide assistance at any subsequent public inquiry. The enclosed statement is written on that basis.
