ON APPEAL: 10/219/A - Mrs P Thompson, Mrs Thusby-Pelham, Mrs S Noble - Approval in principle for erection of a dwelling land between Cliffe Cottage and Greystones, Battery Road, Peel (Appeal by Mr and Mrs H Quirk)
I refer to the recent appeal in respect of the above planning application.
In accordance with the provisions of the Town and Country Planning (Development Procedure) Order 2005, I am enclosing herewith a copy of the report of the person appointed to consider this appeal.
The Minister has considered the report, concurs with the appointed person’s conclusions, and accepts the recommendation that the appeal should be dismissed. Accordingly, he has directed that the Planning Committee’s decision to approve the application should be confirmed, albeit subject to the revised conditions referred to in paragraphs 29 and 30 of the report. Formal notice of this decision is enclosed herewith.

In pursuance of his powers under the above Act and Order, the MINISTER for Infrastructure, following report by the appointed person, does hereby APPROVE the application by Mrs P Thompson, Mrs Thusby-Pelham, Mrs S Noble, Mrs P Thompson, Mrs Thusby-Pelham, Mrs S Noble - Approval in principle for erection of a dwelling land between Cliffe Cottage and Greystones, Battery Road, Peel (Appeal by Mr and Mrs H Quirk)** subject to compliance with the following conditions:-
Approval of the details of siting, design, external appearance of the building[s], internal layout, means of access, landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Planning Authority in writing before any development is commenced.
The application for approval of the reserved matters shall be made to the Planning Authority before the expiration of two years from the date of this permission.
The development to which this permission relates shall begin within 4 years of the date of this permission or within two years of the final approval of the reserved matters, whichever is the later.
The application for reserved matters must include details of how the northern bank of the site is to be protected both during and after construction and development shall take place only in accordance with this drawing.
Reason: To protect the potential habitat for Common Lizards identified by the report by the Manx National Trust submitted as part of this application.
The site boundary to Battery Road shall consist of a Manx Hedge. Where not required to be removed to form the access and visibility, the existing Manx Hedge shall be retained. Where required to be removed, it shall be replaced to form the boundary of the site, except for the space for the gateway. The boundary shall thereafter be retained in this form.
