All new retail development (excepting neighbourhood shops and those instances identified in Business Policy 5) sited within the town and village centr
Requires new retail development (except neighbourhood shops and certain exceptions) to be sited within town/village centres on zoned land, considering Business Policies 7 and 8. The officer assessed this small 27 sq m shop as akin to an acceptable neighbourhood shop in a village setting on Retail/Commercial zoned land.
Business Policy 10
Permits retail only in established town/village centres, except neighbourhood shops in large residential areas and instances in Business Policy 5; neighbourhood shops normally not more than 100 sq m. Officer confirmed the proposal qualifies as a small neighbourhood shop sustainably located with no policy breach.
Transport Policy 4
Requires adequate parking for new development per standards for staff, customers and service vehicles. Existing 40-space car park alongside the A1 more than accommodates low additional traffic from local walk-in customers.
Community Policy 4 of Isle of Man Strategic Plan 2007
Prohibits loss of local shops/public houses unless commercially unviable. Not directly tested as proposal retains public house use and adds retail amid loss of former shop.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Area limited to annotated bar/shop
Approval is only given for the area annotated as "bar/shop" on the submitted ground floor plan, to be used as a shop (Class 1.1) or a public house as part of the use of the remainder of the premises as a hotel/public house (Class 1.3) of the Town and Country Planning (Use Classes) Order 2019: no approval is given for any Class 1.1 use in or on any other part of the building or site. Reason: to clarify the extent of the approval.
