The site represents the residential curtilage of an existing dwelling, Struan Thie which lies on the western side of the Tholt-y-Will road (A14) to the south of Sulby and immediately to the south of the new water treatment works. The property is a traditional cottage which has what are possibly its original timber-framed sliding sashes which are currently painted pale blue/lilac. The windows have a single vertical glazing bar. This type of window is found throughout the property other than in the case of a small square window in the first floor on the rear elevation, three other windows beneath this in the rear elevation and a fixed light in the rear single storey lean-to annex. There is also a top opening casement window in the southern gable elevation above a single storey porch with a brick base wall.
There is a second building within the site - a single storey garage/store to the north of the cottage.
The site lies within an area designated on the Town and Country Planning (Development Plan) Order 1982 as High Landscape Value and Scenic Significance. Within the draft Landscape Character Assessment the site lies within an area of Narrow Upland Glen where the following advice is available:
"4.3 Type B: Narrow Upland Glens
The overall strategy for the protection and enhancement of the Narrow Upland Glens Landscape Character Type is to conserve and enhance: the distinctive well-wooded character of the glens; the distinctive field patterns on lower valley sides, defined by Manx hedgerows with mature trees; the pattern of winding roads, enclosed by sod banks, with small fords and bridges across water courses; the remote, tranquil, and unsettled character; and the various visible cultural heritage features, such as scattered abandoned mines.
Key landscape planning considerations in relation to the protection and enhancement of this Landscape Character Type are as follows:-
The site also lies within an area at risk of river flooding.
Proposed is the replacement of the existing windows with new timber framed sliding sashes throughout, including those windows which are not currently sliding sashes. The vertical glazing bar would be externally expressed, to match the existing.
Planning Circular 1/98 includes the following advice:
"BUILDINGS ERECTED BEFORE 1921 AND NOT FALLING WITHIN CATEGORIES a OR b WHICH HAVE LARGELY RETAINED THEIR ORIGINAL CHARACTER
In an individual building, or group of buildings, whose principal elevations are readily visible from a public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encouraged by the Department. If repair is impracticable, or existing windows are not the originals, the preference will be for replacement windows in the said principal elevations to have the same method of opening as the originals. Whatever the material used in their construction, the windows MUST HAVE the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows.
Windows not part of the principal elevations and which are not readily visible from a public thoroughfare should preferably have the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in their construction."
Planning permission has been granted for the following developments:
PA 88/1767 - alterations and extensions PA 89/0874 - construction of garage with workshop to replace derelict barn PA 94/1794 - change of use of outbuildings to sign and lettering preparation and application.
Planning permission was refused for the erection of a new dwelling on the site under PA 87/4708 and for the change of use of the garage to a dwelling under PA 90/1258.
Lezayre Parish Commissioners indicate that they do not oppose the application.
The existing windows are, in the main original or at least appropriate in material and style to the age and character of the dwelling. The proposed replacements would replicate these and in a number of cases introduce sliding sashes where there are currently less appropriate styles of window. As such, the proposal would represent an enhancement of the appearance and character of the property and would accord with the principles of Planning Circular 1/98.
As such the application is recommended for approval.
The local authority, Lezayre Parish Commissioners are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
C 2. This permission relates to the replacement of the existing windows with timber framed sliding sashes as shown in drawings 1417-EL-01, 1417-EL-02, 1417-P-01 and the sectional details, all received on 15th July, 2011.
I confirm that this decision accords with the appropriate Government Circular delegating functions to Director of Planning and Building Control / Development Control Manager.
