The original application for one telegraph pole was recommended for approval by the case officer but refused by the Planning Committee on 13th October 2025 due to negative visual impact on the streetscene contrary to General Policy 2(b & c). Manx Telecom appealed citing national telecom priorities, previous approvals elsewhere, careful siting, and minimal visual harm outweighed by fibre benefits. DEFA defended refusal referencing visual harm, residential amenity, Infrastructure Policy 3, and precedents from dismissed Tromode estate appeals (AP25/0024). Inspector's report for the similar Tromode case found significant harm to uncluttered character despite telecom benefits. No decision issued yet for this appeal.
Precedent Value
Reinforces Tromode precedent: in estates designed without overhead utilities, new telegraph poles cause unacceptable harm to uncluttered character despite fibre benefits; applicants must demonstrate no underground alternative or accept refusal.
