The Department approved retrospective planning permission for a UPVC door in the rear wall of a domestic garage at Fernlea, opening onto the private car park of Ramsey Automotive Centre, finding no harm to character, streetscene, or amenities. Manx Petroleum (landowner) appealed, focusing on safety risks from conflicting pedestrian and vehicle movements and harm to the business's operations and future development. The inspector, after a hearing and site visit, found the door would cause unacceptable harm to road safety under GP2(i) and prejudice the economic well-being of the existing business under IMSP strategy and GP2(k), despite dismissing civil trespass issues. The Minister accepted the inspector's recommendation to allow the appeal. Permission was refused with reasons mirroring the inspector's conclusions.
