1.0 Description
1.1 Planning Application 23/01057/B was APPROVED on 09.07.2025 for:
Construction and replacement of existing walls for the purpose of providing flood protection to Glen Road, Laxey.
1.2 This approval is subject to 5 conditions, some of which require the submission of additional information prior to the commencement of works.
1.3 This report is specific to conditions No. 4, which the applicants are seeking to satisfy. The specific wording of the condition is as follows:
Prior to the commencement of any works of construction for the development hereby approved, a written method statement outlining measures to minimise disturbance to fish shall be submitted to and approved in writing by DEFA Planning. The works shall then be carried out in accordance with the approved details.
Reason: To ensure a suitable approach to construction, in order to reduce the possibility of injury or disturbance of fish within the river.
2.0 Proposal
2.1 The applicant's agent has submitted an application form on 13.10.2025 along with:
- Section 18 Consent from DEFA Inland Fisheries detailing construction methods
3.0 Consultation
3.1 DEFA Inland Fisheries for the approved application was consulted for advice. Their advice was received on 04.11.2025. They concluded that, after reviewing the submitted documents, this submission satisfy the relevant clauses.
4.0 Recommendation
4.1 In this instance of the submitted documents and after consultation with DEFA Inland Fisheries, which is happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning conditions 5 of application 23/01057/B , under the understanding that the development shall not be carried out unless in accordance with the approved details.
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
