General Policy 2
Requires development to respect site/surroundings in siting/scale/design, not adversely affect landscape/townscape/amenity/character, and reduce energy consumption. Officer found proposal complies as heat pump respects residential curtilage, has minimal visual/noise impact, replaces fossil fuel with renewable, and noise condition safeguards amenity.
Environment Policy 4
Developments involving alternative energy sources judged against environmental policies; no EIA needed for non-wind/water/tide. Officer weighed renewable benefits against minimal environmental impacts (noise/visual), finding supportive of Strategic Plan and climate strategy.
Environment Policy 35
Within Conservation Areas, only development preserving/enhancing character permitted, protecting special features. Assessed as acceptable since Laxey CA value lies in older properties/street pattern; heat pump not more harmful than existing oil tank.
Conservation Area Policy 4 of Laxey and Lonan Area Plan Order 2005
Special attention to preserving/enhancing CA character/appearance. Site at western extent of Laxey CA; proposal does not harm due to screened location.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Noise limit
The heat pump hereby approved must not result in a noise that exceeds 42 dB LAeq 5 mins where "LAeq 5 mins" means the A-weighted equivalent continuous sound pressure level over 5 minutes when measured at 1 metre external to the centre point of any relevant door or window to any neighbouring building as measured perpendicular to the plane of that relevant door or window. Reason: for the avoidance of doubt and to safeguard the neighbouring property from unnecessary noise in accordance with General Policy 2.
