The officer assessed the main issue as the impact on the character and appearance of the Conservation Area and the individual property.
Environment Policy 35
Requires that within Conservation Areas, only development which preserves or enhances the character or appearance of the Area is permitted, protecting special features from inappropriate development. The officer tested the replacement windows/doors against this, finding they replicate the existing non-original fenestration in style, design, pattern and finish, thus preserving the area's and building's appearance despite not being identical to originals.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Noted the building's unique character to Laxey Harbour and Promenade; replacements similar but not entirely like-for-like; resolved not to object and defer to planning officer and committee expertise.
DNO - There will be a need to use the highway for equipment and materials, such as for scaffold and skips for which separate permissions under licences are required.
Garff Commissioners noted the unique character of the building but resolved not to object, deferring to planning expertise. Highways Division does not oppose but notes need for separate licences for highway use.
Key concern: building is unique and fundamental to the character of the Laxey Harbour and Promenade area
