This application has been recommended for approval for the following reason. The proposed sun room extension beneath the balcony above respects the main building and is not considered to have an adverse impact on the surrounding area, as such the proposal complies with General Policy 2 of the Isle of Man Strategic Plan 2016.

Officer’s Report

THE APPLICATION SITE

1.1 The application site is the residential curtilage of Apartment 12, Kings Court Ramsey which is a ground floor apartment situated to the western end of the Kings Court.

1.2 Kings Court is the northernmost and larger of the two large apartment blocks which dominate this part of Ramsey (Queens Court is the other). The apartment blocks were constructed following the demolition and subsequent redevelopment of south Ramsey during the 1960s and 1970s.

THE PROPOSAL

2.1 The current planning application seeks approval to install a sunroom enclosure below the existing balcony above. The size of the enclosure is 1.8m by 4.8m, with a height of 2.4m. There will be a door situated to the south west end of the enclosure with the windows to the southern end having top openers and the windows to the eastern elevation being fixed. The sliding doors to the current lounge/dining room and the window to the bedroom will be staying. The existing fire door would be unaffected by the development and the existing concrete path would remain in place.

PLANNING HISTORY

3.1 There are no previous planning applications for the apartment in question but there are several for the apartment block as a whole with the most relevant to this application being PA09/00238/B which allowed glazing to be installed in any of the apartments' balconies, thereby enclosing the balcony area. The style of the windows has to be the same as that permitted under the application, or a separate planning permission is required. As more than one apartment has installed such windows, that approval will remain extant.

PLANNING POLICY

4.1 The site lies within an area zoned as Predominantly Residential on the Ramsey Local Plan 1998, Map 2.

4.2 Of specific relevance to the assessment of this application is General Policy 2 of the Isle of Man Strategic Plan 2016 General Policy 2 states "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; c) does not affect adversely the character of the surrounding landscape or townscape; g) does not affect adversely the amenity of local residents or the character of the locality; n) is designed having due regard to best practice in reducing energy consumption."

4.3 Also of relevance is Paragraph 8.12.1 which states, "As a general policy, in built up areas not controlled by Conservation Area or Registered Building policies, there will be a general presumption in favour of extensions to existing property where such extensions would not have an adverse impact on either adjacent property or the surrounding area in general."

REPRESENTATIONS

5.1 Highway Services have No Highways Interest in this application (21.01.2020).

5.2 Ramsey Commissioners have considered the proposal and have no objection (06.02.20).

ASSESSMENT 6.1 The key issue to consider in the assessment of this planning application is the potential impacts upon the visual amenities of the street scene.

6.2 The apartment block as a whole has a mixture of apartments with enclosed and open balconies with the majority of the apartments having already enclosed there balconies.

6.3 When looking at the ground floor level on this side of Kings Court there have been a few flats which have enclosed the ground floor space underneath the above balcony.

6.4 The proposed sun room extension underneath the above balcony is considered to be in keeping with the building given the design, form and appearance. Whilst the proposed is not matching in shape and appearance as the other extensions on the ground floor the proposal is deemed to be a modest form of development and is not considered to cause any undue impacts on the private amenity of the local residents of Kings Court.

6.5 During my site visit it could be seen that the proposed sun room extension cannot be seen from the general public when viewed from the roadside and that you would have to go around the residents underground parking garage as such proposal is judged to respect the main building and not considered to have an adverse impact on the surrounding area.

CONCLUSION

7.1 For the above reasons the proposal is considered to comply with General Policy 2 of the Isle of Man Strategic Plan 2016 and therefore acceptable.

INTERESTED PERSON STATUS

8.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons: (a) the applicant (including an agent acting on their behalf); (b) any Government Department that has made written representations that the Department considers material; (c) the Highways Division of the Department of Infrastructure; (d) Manx National Heritage where it has made written representations that the Department considers material; (e) Manx Utilities where it has made written representations that the Department considers material; (f) the local authority in whose district the land the subject of the application is situated; and (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material.

8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed above who should be given Interested Person Status __
