Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.

1.0 THE APPLICATION SITE - 1.1 The application site is the curtilage of The Rowans, Main Road, Kirk Michael which is a dormer detached bungalow located on the western side of Main road and opposite the Mitre Hotel Pub.
2.1 The planning application seeks approval for the additional use of existing dwelling for tourist accommodation. No physical alterations are proposed to the dwelling.
3.0 PLANNING HISTORY - 3.1 There are no following previous planning applications which are considered relevant in the assessment and determination of this application.
4.0 PLANNING POLICY - 4.1 In terms of local plan policy, the application site is within an area recognised as being within predominantly residential use under the Kirk Michael Local Plan. The site is not within a Conservation Area. - 4.2 In terms of strategic plan policy, the Isle of Man Strategic Plan 2016 contains two policies that are considered specifically relevant to the assessment of this current planning application: - 4.3 General Policy 2 states: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
4.4 Environment Policy 35 states: "Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development." - 4.5 Business Policy 13 states: "Permission will generally be given for the use of private residential properties as tourist accommodation providing that it can be demonstrated that such use would not compromise the amenities of neighbouring residents."
5.0 REPRESENTATIONS - 5.1 Kirk Michael Commissioners have sought a defferal (24.01.2020). - 5.2 Highway Services do not object (10.01.2020).
6.1 The key issue to considerer in the assessment of this planning application is the principle of the use of the dwelling for tourist purposes. PRINCIPLE OF THE USE OF THE DWELLINGS FOR TOURIST PURPOSES - 6.2 As outlined in Business Policy 13 permission will generally be given for the use of private residential properties as tourist accommodation providing that it can be demonstrated that such use would not compromise the amenities of neighbouring residents. The site is locates within the centre of Kirk Michael adjacent close to shops, attractions and services. It is considered the use of the existing dwelling for tourist purposes would be an ideal location for visitors. It is not considered the use of the dwelling for tourist purposes would raise any significant impacts upon neighbouring properties.
7.0 CONCLUSION - 7.1 Overall it is concluded that the planning application accords with the provisions set out in General Policy 2 and Business Policy 13 of the Isle of Man Strategic Plan 2016 and as such the planning application is recommended for approval.
