In terms of the Building referred as “Babbages” and the use for food and drink, was the permission sought to allow non-workers on the site to visit the existing café? Is it only the existing café area which you are wanting for the food and drink or the entire ground floor? Dear Jonathan
As mentioned previously I have concern with the application as it stand; given the very wide range of uses proposed, throughout the site; which essentially if approved, the site could become a storage and distribution centre for a large company (supermarket etc). I note the Commissioners have raised concern of Class 6 in relation to HGV’s which I would agree with (site previous refused on this issue). At the moment I believe the range of what could be used is too great. While I appreciate from our discussions you are unlikely to undertake such development, the issue we have is any permission runs with the land and not the person/company making the application.
Having considered this, we do not feel that adding storage and distribution as a class is necessary for us to move forward with the application and so on that basis we would be happy to effectively withdraw that request or be prepared to accept its refusal at committee.
I have outlined the current uses and the proposed uses below and what could result – with the issue of the storage and distribution, especially in the larger buildings be relevant also:

3 Main Film Studio Building Current Uses – Sound Stage, Community, exhibition conference, events, meeting area and training centre. With the exception of the sound stage (filming), the remaining uses are condition to be at certain hours of the day and limits the days throughout the year such uses can occur (please see history section of this report to see conditions listed).
Proposed additional uses – Food & Drink; Light industry and Research & Development (excluding light industrial); and Storage or distribution. In relation to food and drink this essential would mean we would be given the entire building to be a restaurant, which would likely raise a concern. Is this what you want or did you include it for other reasons? For example the events you have i.e. wedding/corporate events you would likely be able to serve food/drink anyway and wouldn’t need a “Food & Drink” permission, if that makes sense? We have included food and drink provision in the Studio building for completeness and to make the events areas on the site more cohesive. As it is not our intention nor in the plan to use that space as a standalone restaurant or café but rather to facilitate events, which is covered in our current permissions, we would again be happy to effectively withdraw this element of the application or accept refusal at committee.
Building referred as “Babbages” which is to the north and attached to the main film studio building. Current Uses - At ground floor level - Community, exhibition, conference, events, meeting area and training centre. Further small individual offices (current leased to small individual business) and the café/kitchen area (former canteen) which currently only serves employees on-site. At first floor level there are two rooms, one used as the original hair, make up and laundry and the second used as a conference, meeting area and training room.
Proposed additional uses – Food and drink, financial and professional services, offices at ground floor and at first floor financial and professional services and offices. – Again same issue with the food and drink, what is it you are hoping to achieve for this use? Whilst we can understand your concerns with the Studio building being designated for food and drink, we are struggling to understand your concerns with the Babbage’s building having permissions for such. I think for us to be able to adequately explain we need to understand what your concerns are with this specifically.
Existing two storey office block with attached small sound stage/workshop. Current Uses - At Ground floor and first floor the office building is used as offices, varying in open plan and individual rooms which are again lease to individual companies as well as the applicants own company, although form visiting the site this appears to be the office at first floor level. We note you have said ‘appears to be the office at first floor level’ and feel it would be remiss of us not to clarify that your assumption is incorrect. Both floors of this building are used as offices for our Company.
The small sound stage/workshop building which is an open plan single floored building which can be used as a sound stage/workshop, but also as an exhibition, events, meeting and training room.
Proposed additional uses – For the current office building and the small sound stage/workshop building it is proposed for the following additional uses; financial and professional services, office, Research & Development, and Storage or distribution. Same issue with Storage and distribution. Again, whilst we understand your concerns regarding the large studio building in relation to class 6 due to the scale and capacity of the Studio building, we do not understand the reluctance with regards the small sound stage / workshop building. Due to the size of the area, it is inconceivable that it would be utilised for anything on the scale you are suggesting. Any storage and distribution would be on a much smaller scale.
While some of the uses (Research & Development & financial and professional services) you are seeking I think are fine, I think the storage and distribution is an issue, namely to the potential of the size of the larger building and/if they were combined have the potential to raise concern and would also result possibly in HGVs

I have forwarded your request to make a complaint to my colleague Jo Callow who should be in contact with you soon to outline the process.
In terms of the application I am afraid there is currently delays in more complex applications, as I have a significant backlog of this type application (some much older than this one) which I have been concentrating on. I would say your proposal is not straight forward and I do have concerns of the number of uses and potential of impacts they may have. I will prepare my report next week.

I haven’t received any further update from you regarding the progress of our Change of Use application (19/01449/C) since your email below of 13th May. Could you please advise on the following points as a matter of some urgency:
It is extremely disappointing that it has been over 23 weeks since the application was first submitted and it appears like nothing has happened? As you can imagine this is incredibly frustrating for us, as a business, to still not know almost 6 months later.
I’d like to have the opportunity to highlight that there has been such a long delay/backlog, and that perhaps the planning department is currently understaffed. Please can you inform me of the official complaints procedure I would need to follow in order to do this by return? This is nothing personal to yourself, I just feel if I don’t highlight this then it will continue to happen.
I thought as there was no objections and only 1 minor comment from the commissioners this application would be fairly straight forward?
Please can you explain how it has taken so long? Is the officers report not something which could have been done during lockdown?
