The Department determined the application complies with General Policy 3 (development in the countryside), Environment Policy 1 (safeguarding countryside character), Environment Policy 19 (rural build…
General Policy 3
General Policy 3 governs development in the countryside, allowing limited exceptions for necessary rural uses. The officer assessed the equestrian arena and store as compliant given the private equestrian need and controls on design and use.
Environment Policy 1
Environment Policy 1 requires safeguarding the character of the countryside from inappropriate development. The proposal was found acceptable with conditions on materials, lighting, and landscaping to minimise visual impact.
Environment Policy 19
Environment Policy 19 addresses rural buildings, permitting those that respect local character. The dark green colouring and private use restriction satisfied the policy tests.
Environment Policy 21
Environment Policy 21 supports agricultural and equestrian development where justified. The private equestrian purpose met the policy criteria, with use limitations imposed.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
No external lighting
There shall be no external lighting of the development hereby approved. Reason: In the interests of the character and appearance of the site and surrounding area.
Private equestrian use only
The arena and stable building hereby approved shall be for private equestrian use only and not for any commercial or private livery use. Reason: The application has been considered on the basis that the external arena and stable building are to be used for private use only and not for any other purpose.
Landscaping scheme
No development shall take place until full details of soft and hard landscaping works have been submitted to and approved in writing by the Department and these works shall be carried out as approved. Details of the soft landscaping works include details of new planting (including tree planting) showing, type, size and position of each. All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the store/indoor arena, whichever is the sooner. Any trees or plants which die or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species. Details of the hard landscaping works include footpaths and hard surfacing materials. The hard landscaping works shall be completed in full accordance with the approved details prior to the first occupation of the development hereby permitted. Reason: To ensure the provision of an appropriate landscape setting to the development.
Materials approval
The external walls, roof, doors and door frames shall be a dark green/olive green colour and retained as such thereafter. Reason: In the interests of the character and appearance of the site and surrounding area.
Equestrian purposes only
The building must be used only for equestrian purposes. Reason: The countryside is protected from development and an exception is being made on the basis of equestrian need. As such the building must be used for the purposes for which it is approved.
