SATISFACTION OF CONDITION
Description Erection of 16 dwellings with associated infrastructure and landscaping works
Proposal 2.1 The approved application included three conditions:
C8. The implementation of the tree protection measures required under condition 2 shall be monitored throughout the construction process by a suitably qualified and pre-appointed tree specialist, in accordance with section 7 of the Arboricultural Method Statement prepared by Manx Roots and submitted in support of the application.
Reason: In order to ensure compliance with the tree protection plan and arboricultural supervision details submitted under condition 2 and to ensure that professional technical advice is on hand to deal with problems that arise or modifications that become necessary
C 13. Prior to the commencement of the development, full construction details of the proposed footway between the site and the existing highway bend of Annacur Lane shall be submitted to and agreed in writing by the Department. The footway shall be constructed in accordance with the approved details prior to first occupation of the development.
Reason: It is essential for a footpath link to be in place between the site and Annacur Lane for highway safety and amenity purposes.
Assessment
3.1 The details submitted provides the required level of details which have been considered acceptable previously (18/00862/B), in terms of the construction details of the proposed footway and therefore are considered acceptable again. In terms of Condition 8 this is not for determination now but monitored throughout the construction process by a suitably qualified.
3.2 Accordingly, it is considered Condition 13 can be approved, but not Condition 8 at this stage.
