Environment Policy 1
Protects countryside and ecology outside settlements; development not permitted unless overriding need and no alternative. Given the nature of the application (condition removal, no new development), it did not adversely affect the countryside.
General Policy 3
Restricts development outside zoned areas except essential agricultural housing (among listed exceptions). The original approval was under this exception, but removal justified as agricultural need ceased.
Housing Policy 8
Requires agricultural dwellings to have occupancy conditions restricting to agricultural workers. The policy underpins the original condition, but removal assessed against related guidance.
Paragraph 8.9.4 of The Isle of Man Strategic Plan
States agricultural occupancy conditions not usually removed unless long-term need for agricultural workers on the farm and locality no longer warrants reservation. Officer found this test met via evidence of unviability and no local demand.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Residential use only
The dwelling may be used only as a single private residential property. Reason: To clarify the intention of the decision.
