1.0 SITE 1.1 The application site is Unit 11, New Units, Balthane Industrial Estate, Ballasalla. This is a commercial site within an industrial estate on the outskirts of Ballasalla.

1.2 The unit itself is part of one of 4 large rows of 6 warehouse units each, with their own access, and finished at the front with plain grey cladding. At present there are 4 window openings on the north elevation of the easternmost set of units, and a window opening on Unit 1 opposite the site unit. The proposal unit sits within the second warehouse building from the park entrance.
2.0 PROPOSAL 2.1 The proposal is for the installation of a new window opening at the front of Unit 11. The opening would be above the single doorway entrance, to the right of the large roller door. It is proposed to measure 2200mm wide and 936mm high.
3.0 PLANNING HISTORY 3.1 07/00156/B - Creation of six windows to the side and rear elevations and formation of internal mezzanine floor, Unit B7, Balthane Industrial Estate. APPROVED. This was a nearby application and did not raise any concerns in the planning officer report or in terms of objection.
4.0 PLANNING POLICY 4.1 The Area Plan for the South (Map 4 Ballasalla) designates the site area as zoned for Industrial use.
4.2 Is assessing this planning application, it is important to consider the proposal against the policies set out in the Isle of Man Strategic Plan 2016, particularly the following:
4.3 General Policy 2 (in part): "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them."
5.0 REPRESENTATIONS 5.1 Malew Parish Commissioners have no objection to the application (03.10.18).
6.0 ASSESSMENT 6.1 This proposal is assessed against General Policy 2. The proposal is not deemed likely to have any impact on the amenity of neighbouring businesses and users. With regard to the site itself, its general amenity may benefit from the increase in natural light, and the proposal is regarded to respect the site and surroundings in terms of both form and design of the window opening. The current window openings on the eastern units have been uncontroversial, it is probable that this window opening would also be uncontroversial. 6.2 The character of the area is industrial and therefore the installation of a window on Unit 11 would not have any negative impact on its appearance. 6.3 It is not regarded that there is any risk at present of the unit being used as a residential dwelling given its location and lack of other alterations. The window in itself would not further such a risk.
7.0 CONCLUSION 7.1 The proposal is in keeping with the land-use designation in the Area Plan for the South, and complies with Strategic Policy and is therefore acceptable.
8.0 INTERESTED PERSONS STATUS 8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013 Article 6(4), the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent;

(b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material (d) Highway Services Division of Department of Infrastructure and (e) The local authority in whose district the land the subject of the application is situated.
8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and __
