The officer assessed that the proposal is not materially different from the 2014 approval (PA 14/01094/B), with no changes in policy or site circumstances justifying a different decision.
Housing Policy 11
Allows conversion of existing rural buildings to dwellings subject to criteria. Officer noted the building was once residential, converted to agricultural use, with partial implementation of prior conversion permissions, but it does not fit comfortably as it is not currently a dwelling; however, proposal aligns with policy intent for improvement.
Housing Policy 12
Allows replacement of existing countryside dwelling if not abandoned, not of architectural/historic interest, and capable of renovation. Existing building assessed as abandoned for residential use (non-residential >10 years, poor condition), not of interest, justifying replacement.
Housing Policy 14
Replacement dwellings must not be substantially different in siting/size (floor area ≤50% greater), on existing footprint, traditional design per Planning Circular 3/91. Proposal exceeds 50% (68% or 35-45% depending on inclusion of annex/shed), rotated 90 degrees, but approved exceptionally as it improves form, reduces visibility, uses traditional stone/slate, and prior extension permission allowed 37% increase.
Time limit - 18 months
The development hereby approved shall be begun before the expiration of eighteen months from the date of this decision notice. Reason: to comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals and to take into consideration the continued declining structural condition of the building
No further extensions or alterations
Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2012 (or any Order revoking and/or re-enacting that Order with or without modification) no extension, enlargement or other alteration of the dwelling(s) hereby approved, other than that expressly authorised by this approval, shall be carried out, without the prior written approval of the Department. Reason: To control development in the interests of the amenities of the surrounding area.
Site restoration and landscaping scheme
Prior to the commencement of any works on site, the applicant must have approved by the Department a scheme for the improvement and restoration of the land to the north west and south east of the proposed dwelling, removing all unauthorised tipped material. Such works must be implemented no later than within the first planting season following the completion of the approved works. Reason: In the interests of public amenity as viewed from the public footpath.
no objection seeing as the proposal is no different to that previously approved (12.10.18)
Department of Infrastructure (DOI) Highways Division does not oppose the application to extend the time limit for demolition and erection of a dwelling and garage, as there are no changes to site access or parking from the previous approval.
Department of Infrastructure (DOI) Highways Division
No ObjectionThe application confirms that there would be no changes to the proposed site access and parking arrangements for the development compared to the previous 14/01094/B planning approval.; No new highway issues should therefore arise as a result of the proposed extension of time for the proposals to be constructed.; Highway Services does not oppose the application.
