In accordance with paragraph 12(5)(a) and (b), a copy of the appointed person's report is enclosed. On the 22nd September 2011, and after consultation, the Council of Ministers accepted the recommendation contained within that report and the application was approved subject to compliance with the conditions specified below.

SCHEDULE OF CONDITIONS:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
2. This permission relates to the erection of four non-illuminated advertising signs as shown on drawings Location Plan, DESC 1008, 1009, 1010 and photographs received on 24th June 2011.

No: DF11/0015 Application by Department of Infrastructure - Property Division for the erection of four non-illuminated advertising signs at the Sea Terminal, Victoria Pier, Douglas.

PRELIMINARY MATTERS

1. This report is based upon written representations and a site visit carried out on Wednesday 17 August 2011. It contains a description of the site and proposal, a summary of the submitted representations and my assessment and recommendation.

SITE DESCRIPTION AND PROPOSAL

2. The application site involves existing buildings at the Sea Terminal, Victoria Pier, Douglas and where a new coffee bar franchise has been established under the name of Fancy A Coffee Limited. It is proposed to erect four separate non-illuminated signs advertising "Costa" coffee on the front, north and south elevations of the building. The signs would each be 2.6 metres by 0.9 metres in extent and constructed in aluminium and brushed stainless steel with a red background and white lettering.

CONSULTATIONS

Planning Division of the Department of Infrastructure

The material points are: 3. The Division state that the site is zoned as Harbour Related Uses on the 1998 Douglas Local Plan; it is also within the Douglas Promenades Conservation Area. The Division considers the signs to be of a high standard of design and materials; the addition of the signs would not cause a highway safety hazard or detract from the surrounding area. Accordingly, the signs would not have a harmful effect upon the character and appearance of the Conservation Area or locality generally. If permission is granted, two conditions should be attached.

ASSESSMENT

5. I concur with the comments made on behalf of the Planning Division and am of the opinion that the signs would preserve the character or appearance of the Conservation Area. However, at my site visit, I noted that the large illuminated signs usually intended for information as to sailing times are being used to advertise the coffee bar use. I understand the Enforcement Officer is investigating the matter. I wish to make it clear that those advertisement signs are not part of the current proposal or of my assessment and recommendation.

RECOMMENDATION

6. I recommend that planning permission be granted subject to the following conditions:-
