The officer concluded the site is unsuitable for a takeaway due to inadequate parking causing illegal on-street parking on zigzag markings and double yellow lines near a signalised pedestrian crossing…
Transport Policy 6 - Equal weight for vehicles and pedestrians
Requires protection for pedestrians as well as other road users. Officer assessed against site parking inadequacy near signalised crossing causing illegal parking, reduced visibility, and reversing onto A5, failing highway safety tests despite 30+ years prior use.
General Policy 2
Requires development not to adversely affect amenity (g), provide safe access/adequate parking/manoeuvring (h), or impact road safety/traffic (i); also General Policy 3h/i for manoeuvring. Failed due to unproven no-harm to residents from noise/odour and highway risks from poor parking layout near busy road/crossing.
Environment Policy 22
Presumes against development harming amenities via odour/noise pollution. Insufficient flue details challenged by neighbour engineers as not meeting commercial standards for noise (30dB unachievable) or odour control, unproven in residential area.
Great addition, brings people to area, keeps money local
No objection subject to no surface water to foul sewer and grease trap installed/maintained
Manx Utilities Authority raised no objection subject to conditions on drainage and waste disposal; Malew Parish Commissioners objected due to drainage, waste storage, noise, smell, and highway safety concerns; DOI Highways Division opposed the application.
Key concern: Vehicular access onto the property could be hazardous as during busy times it may be necessary for vehicles to reverse directly on the main road which is an arterial route
Manx Utilities Authority
Conditional No ObjectionUnder section 6 of the Sewerage Act 1999 there must be no discharges of any matter likely to injure the sewer or drain, to interfere with the free flow of its contents or to affect prejudicially the treatment and disposal of its contents.
Conditions requested: There must be NO discharge of surface water (directly or indirectly) from this proposed development to any foul drainage system(s) so as to comply with the requirements of Manx Utilities and the Sewerage Act 1999.; No discharges of fat or other food waste, which will affect the performance of the public foul sewerage system, will be permitted to the foul sewer. It will be the responsibility of the developer/occupier of the premises to provide satisfactory means of disposal for such waste. A grease/fat trap is recommended to be installed and maintained by the occupier/owner to prevent any such waste entering the drainage system.
