Officer’s Report
THE SITE 1.1 The site is the curtilage of an existing single storey commercial unit which fronts onto Station Road in the centre of Port Erin. The unit backs onto an open area which in turn is adjacent to a rear lane which serves the commercial properties on Station Road and Church Road.

THE PROPOSAL 2.1 Proposed is the replacement of an existing small rear toilet extension with a larger, flat roofed annex which 700mm from the rear of the existing toilet annex and extends to the western boundary of the site. The purpose of this additional floorspace is not specified but the space would be accessible from the front showroom and also providing access to the toilets. Pedestrian access across the yard is available to steps up to the rear area outwith the site and near the rear lane. Vehicular access into the site is not available.
PLANNING POLICY 3.1 The site is within an area of Mixed Use on the Area Plan for the South (2013). As there is no change in use, the following elements of the Strategic Plan are considered relevant:
General Policy 2: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
(b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; (g) does not affect adversely the amenity of local residents or the character of the locality."
PLANNING HISTORY 4.1 There are no applications which considered relevant to the current proposal.
REPRESENTATIONS 5.1 Port Erin Commissioners indicated on 4th July, 2018 that they would confirm their position on 11th July, 2018. No further response has been received.
ASSESSMENT 6.1 The proposal is for a modest extension which will not be publicly prominent due to its location at the rear. The proposal will be visible to those in the vicinity of the site and possible visible to anyone looking over the stone wall to the west but what will be seen is a slightly higher rendered boundary wall which will be neither prominent not unsightly.
6.2 The proposal has no impact on highway safety or traffic movements.
CONCLUSION 7.1 The application is considered to accord with GP2 and have no adverse environmental impact and is supported. It is not considered necessary to defer the application to await the views of Port Erin Commissioners in this instance.
INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013 Article 6(4), the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material (d) Highway Services Division of Department of Infrastructure and (e) The local authority in whose district the land the subject of the application is situated.
8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and

o whether there are other persons to those listed in Article 6(4) who should be given Interested Person Status.
