General Policy 3
Permits engineering operations essential for agriculture (paragraph f). Officer found the field accesses essential for safer livestock crossing, complying as an exception to development restrictions in unzoned countryside.
Environment Policy 1
Protects countryside unless overriding national need. Assessed as not adversely affecting countryside given the minor scale and agricultural purpose.
Environment Policy 2
Protects Areas of High Landscape or Coastal Value unless no harm or essential location. Gates considered not out of place in rural character with sod banks and hedges.
Transport Policy 4
Requires highways to accommodate development safely. Satisfied post-amendments addressing visibility, surfacing, and gate design.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Block existing gate
Within one month of the access within field 120316 being completed the field gate within 120241 is required to be blocked up either with a sod bank and/or hedge as shown within the approved drawing 856.10. Reason: In the interest of highway safety and the visual amenities of the area; also this is what has been proposed within the application.
no objection
Highway Services raised concerns about mud transfer, hedge heights, and inadequate visibility splays on a high-speed road, recommending deferral for revised plans; Andreas Parish Commissioners had no objections in both consultations.
Key concern: inadequate visibility splays of 2.4m x 160m required due to high-speed road location
Department of Infrastructure Highways Division
Defer"Revised visibility splays of 2.4m x 160m should therefore be shown on a revised scale site plan"; "Highway Services request that the application is deferred to allow the applicant to consider the above"; "Recommendation: DEFER"
Conditions requested: proposed site entrances to be constructed from suitable hard surfaced material; hedges/vegetation to be maintained at maximum height of 0.9m within the highway visibility splay areas
