C 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
C 2. For clarification, this approval relates to the installation of replacement windows on the front elevation and the replacement of the existing rear door, all as shown in the submitted information with the front elevation windows being sliding sash with horns on the lower side of the upper sash.
Reason: To clarify the extent of the proposal.

Officer’s Report
THE SITE 1.1 The site is the curtilage of an existing dwelling, 39, Malew Street, which is a three storey terraced property which sits on the western side of the road and within the town's Conservation Area. To the rear of the site are the town's tennis courts.
1.2 The property has an uncharacteristic and striking archway which provides vehicular access to the rear of the building. There are three rows of windows within the frontage: the ground floor has only one window to the right of the front door which is a green coloured timber door with solid lower half and glazed upper part subdivided into a number of panes with three smaller panes at the top and bottom of the glazed area. To the left of the front door is the archway. Above this is a row of three windows and these, with the ground floor window are vertically proportioned windows which have been fitted with timber framed casement opening windows with each half subdivided into two with a single vertical glazing bar. Above this are three square windows with the same glazing pattern.
1.3 The rear of the property has the same pattern of glazing in the first and second floors with the same style of door and a double width window to the left of the door.
1.4 Despite its general traditional style (apart from the large opening) the property was built relatively recently (see Planning History).
THE PROPOSAL 2.1 Proposed is the replacement of all of the windows: those in the front are to be replaced with plastic framed sliding sashes, each having an externally applied glazing bar and decorative horns attached to the underside of the upper sash. On the rear the windows will be casement opening.
2.2 The two doors were originally also to be replaced: the front door is to be replaced with a solid timber effect composite door which has a small vertically proportioned light with decorative glass. This is to have a natural timber finish. The rear door is to be mostly glass in two sections in a plastic frame. Following comments made about the front door, the applicant wishes to remove this from the proposal.
PLANNING POLICY 3.1 The site lies within a Conservation Area where there is a requirement for development to preserve or enhance the character or appearance, in line with EP35 of the Strategic Plan and PPS101.
PLANNING HISTORY 4.1 The property has been the subject of two previous applications, one for a satellite dish and one for the erection of a dwelling - 90/01605/B which was approved. This was implemented and represents the property which stands on the site at the present time. Its relatively recent construction explains the uncharacteristic arched opening.
REPRESENTATIONS 5.1 The Isle of Man Victorian Society support the proposal for sliding sash windows and suggest that a condition to be applied to ensure there are horns. They have no objection to the replacement windows and doors at the rear. They suggest that the style of replacement door at the front is not correct and recommend a solid door with four equally sized panels and should be a colour, not timber effect (29.05.18).

ASSESSMENT 6.1 The replacement of casement windows with sliding sashes is a welcome enhancement and the door at the rear will not be publicly visible. As the proposal shows horns on the windows and they also appear on sliding sashes on properties in the vicinity, it would be appropriate for the windows to have them and a condition reflecting this is recommended.
CONCLUSION 7.1 The proposal accords with the requirements in EP35 and PPS 1/01 to enhance the character or appearance of the Area and is supported.
INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013 Article 6(4), the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material (d) Highway Services Division of Department of Infrastructure and (e) The local authority in whose district the land the subject of the application is situated.
8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed in Article 6(4) who should be given Interested Person Status.
