Time limit
This approval is for a period of 10 years only.
Working setback and fencing
There shall be no working within 10m of the perimeter of the site which must be securely fenced off from the adjacent plantation.
Access restrictions
All access to the quarry extension area for the purposes of stripping overburden and excavation must be taken from haul roads within the quarry.
No public access
There shall be no access to the site from any realigned footpath/track through the plantation to the north west and south west of the quarry.
Footpath realignment
No development shall take place until adequate provision for the realignment of the footpath/track outwith the site has been made to the satisfaction of the Department of Agriculture, Fisheries and Forestry and the Planning Committee.
Landscaping and mitigation
For the purposes of mitigating the impact of the development on the landscaping, in addition to the landscaping proposals shown on plan IMN 0002/001D/01 the following shall be undertaken: - all disused buildings and structures, derelict machinery and equipment must be removed before regrading takes place. - excavation and regrading of existing overburden banks must be undertaken simultaneously. - planting of regraded slopes should be undertaken, at the latest, in the first planting season following commencement of excavation of the extension. - no more than a 20m wide strip of land shall be cleared of trees and overburden in advance of working. - overburden so stripped shall be moved immediately to the areas shown on plan IMN 0002/001D/01 and no overburden shall be left in piles on unexcavated ground. - all topsoil and overburden must remain in the quarry and be used in the landscaping works.
Afteruse plan
Plans for the afteruse of the whole quarry area must be agreed with the Department of Agriculture, Fisheries and Forestry and Department of Local Government and the Environment and submitted to the Planning Committee within 5 years of the approval of this application.
Drainage
Adequate provision must be made for the drainage of the site and there must be no pollution of adjacent watercourses, the Committee reserve the right to monitor the effect of the excavation in creating additional surface water and the effectiveness of the existing drainage system and to request additional works if necessary to cope with any problem arising.
Working hours
The working hours of the operations on the site shall be restricted to Monday - Friday 0800 - 1700, Saturday 0800 - 1200. The site shall not be operated on Sundays and Bank Holidays. For the purpose of this condition operations include drilling, blasting, movement, crushing and screening of rock and grading of overburden.
No external tipping
There shall be no tipping of materials generated from outwith the site.
Safety measures
To ensure safe working of the site the following practices must be adopted: - the working faces shall be benched so that no vertical or near vertical face exceeds 15 metres in height. - no haul road shall be at a gradient steeper than 1 in 12, and the edges of the haul road shall be protected by 1.5 metre high earth banks to prevent vehicles falling from the edges of the haul road. - the quarry owner should be able to satisfy the Committee that no shot is fire by any person who is not competent to do so in a safe and workmanlike manner in accordance with the Isle of Man Quarries Regulations (Use of Explosives) 1951. Also, in accordance with the general duty imposed by Section 3 of the Health and Safety at Work etc Act 1974 as applied to the Island, the other persons who may be affected by the way in which the undertaking is carried out, in particular by ensuring that appropriate blasting techniques are used to avoid danger to persons in nearby premises from the dangers of fly rock.
Separate permission for buildings
Separate planning application must be made for any new building, fixed plant and equipment.
No advertisements
No advertisement matter of any description shall be exhibited at this site without the PRIOR written permission of the Committee.
Archaeology notification
Manx National Heritage should be advised, in advance of the start of site clearance operations and given the opportunity of inspecting the site from the commencement of earth movement and during the excavation of all trenches (including service trenches) as deemed necessary and of investigating any archaeological features exposed.
Archaeological finds
All workmen on the site should be informed of the sensitive nature of the site so that any finds and/or traces of archaeological activity can be reported promptly to the Manx Museum in accordance with Manx Law. Attention is drawn to the requirements of the Manx Museum and National Trust Act 1959/86.
Department of Transport (DoT) Highways Division objects to the quarry extension due to inadequate highway infrastructure to safely accommodate generated traffic, contrary to Transport Policies 4 and 6 of the Isle of Man Strategic Plan 2007.
Key concern: existing transport infrastructure will not safely accommodate the traffic generated by the development contrary to Transport Policy 4
