Tel 01624 685950 Mrs Samantha Lund Hill View Crescent Road Ramsey IM8 2JR TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013 In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Mrs Samantha Lund, Ref 18/00376/B, for the Alterations in connection with an additional use of hall as a children's day nursery, including the erection of timber fencing to create a secure outdoor area at Lezayre Church Hall Churchtown Ramsey Isle Of Man IM7 2AN subject to compliance with the following condition(s) and notes (if any): 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals. 2. The maximum number of children attending the building at any one time shall not exceed thirty two. Reason: In the interests of the amenity of the surrounding area along with highway safety and parking and to safeguard the welfare of children. 3. Prior to the operation of the nursery all fencing/field gate which are required to be painted in a dark green/brown colour and are required to be erected/installed as shown on submitted drawings LCH-PA-01 received 11.05.18 and "Site Plan" received on 12.06.18 and retained thereafter. Reason: In the interests of safeguarding the welfare of children, highway safety and in the interest of visual amenities of the area. 4. No nursery customers (children or parents) shall remain in the building outside the following hours 0745hrs till 1830hrs. Reason: In the interests of the residential amenity of the area and as the application has specifically listed these times (albeit a slightly earlier opening & later closing time is suggested, taking account of people being early & late for drop off and pick-ups) and the application has been considered on this basis.

The "field gate" as required to be installed under Condition 3 shall be locked during the operation of the Nursery. Reason: In the interests of highway safety This approval relates to the submitted documents date stamped 09.04.18 and drawings reference number LCH-PA-01 date stamped 11.05.18 and "Site Plan" date stamped on 13.06.18. Any appeal against this decision must be in accordance with the criteria set down in that instrument. Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain: · Payment of a planning appeal fee as prescribed in the Town and Country Planning (Application and Appeal Fees) (No2) Order 2016 (currently £175); · The reasons for making the appeal; and · An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation. An appeal form and guidance notes are available from either Planning & Building Control, Tel 685950, or to download from the Department’s website https://www.gov.im/categories/planning-and-building-control/planning- applications/planning-appeals/how-to-appeal/ If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department’s public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House. Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.
