There appears to be some confusion over the advice asked for and received. If the pipe going under the highway is private to serve your property and not maintained by the MUA then a land ownership form is required; I am sure that you can forward this to planning once you have submitted your application.
A section 75 agreement is required between yourself and the department to permit private services to be laid within the highway.
Once you have received planning permission please contact this office and we will assist with both the sect 109A and the sect 75 agreements; Manual for Manx Roads available on the right hand side of this webpage will provide additional information on these agreements.

Andrea Hawley has given me your contact details, in relation to my query about our planning application for a replacement sewage treatment plant, that involves running a short section of pipe under the highway, so that the output from the plant can be discharged to the river (building regs and discharge licence already in place). When I was in the planning office getting help to prepare our planning application, it was suggested that we should contact you, in order to find out whether we need to fill in a land ownership form, regarding the bit of pipe that runs outside our curtilage, under the public highway. We are having the work done by an experienced contractor, who I'm sure knows about the forms that need to be filled in before work commences (ie section 109(a) etc), but planning permission isn't normally required for the work he does. The planning office weren't sure if you'd need us to submit a land ownership form, with regards to the section under the highway, to accompany our planning application. They thought maybe not, because you will be notified about our application automatically, once they've put it on their system.
