Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.

1.1 The site is the curtilage of a mid terraced two storey cottage situated in Milner Terrace which fronts onto Milner Terrace opposite the Commissioners' depot in front of which is area of open recreation space (which is presently used by a local nursery) and backs onto a rear lane shared by the properties in Athol Terrace which back onto the lane and front onto Qualtrough's Timber Yard.
1.2 The application property is a traditional cottage, like the others in the terraces. It has a small rooflight in the rear pitch which has dimensions of around 51cm by 35cm and a central glazing bar separating the two panes. THE PROPOSAL - 2.1 Proposed is the replacement of the rooflight with a new one which is slightly larger - 55cm by 78cm. this will be a regular centre pivot rooflight with no subsidiary glazing bars. PLANNING POLICY - 3.1 The site lies within an area designated on the Area Plan for the South as Predominantly Residential and within the town's Conservation Area.
3.2 As such, the following Strategic Plan policy is considered relevant in the consideration of the application:
Environment Policy 35: Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development.
3.3 This echoes the provisions of the Planning Policy Statement 1/01 - Guide to Conservation of the Historic Environment of the Isle of Man.
4.1 The site has been the subject of applications for the replacement of roof materials, doors and windows none of which is particularly relevant to the consideration of the current application. REPRESENTATIONS - 5.1 No representations are on file at the time of writing. ASSESSMENT - 6.1 The existing rooflight is not visible, shielded from public view by the orientation of the terraces. Similarly, the proposed rooflight will not be visible and the proposed development will therefore not have any adverse impact on the appearance and character of the Conservation Area. CONCLUSION - 7.1 The proposal complies with the requirements of EP 35 and is supported.
