Officer’s Report
THE SITE 1.1 The application site forms part of an existing stone built two storey building situated at Ballastrang Farm, Douglas Road, Malew. Ballastrang Farm is situated west of the main road just south of the Fairy Bridge and is accessed by a shared access lane which joins with the Castletown Road.

1.2 The existing building is currently divided into two units; a small tourist unit on the north eastern side and a recently approved veterinary clinic on the south western side PA 17/01124/C.
THE PROPOSAL 2.1 Advertisement consent is sought for the installation of 3 permanent non-illuminated signs relating to the veterinary clinic.
2.2 Two signs are proposed to be fixed to either side of the main entrance nearest the Castletown Road. Each sign will be 1200mm wide x 750mm high and fixed directly to the stone walls. The signs will be finished in white Perspex and will include the business logo in blue and the contact details below in black.
2.3 One free standing sign is proposed within the curtilage of the clinic building adjacent to the vehicle entrance. This sign is to sit on timber posts 1.5m high. The sign itself will match those fixed to the roadside entrance 1200mm wide x 750mm high and finished in white Perspex with blue and black text.
PLANNING HISTORY 3.1 The application site has been subject to a number of previous planning applications, the most relevant in the assessment of the current application is PA 17/01124/C for the conversion of the existing barn into a veterinary clinic which was approved in Dec 2017.
PLANNING POLICY 4.1 The site lies within an area zoned as 'white land' on the Town and Country Planning (Development Plan) Order 1982 and also with an area designated as High Landscape or Coastal Value and Scenic Significance (AHLV).
4.2 The Control of Advertisements Regulations 2013 make it clear that the only considerations which can be applied to applications made under them are in the interests of amenity and public safety. In the case of amenity, such things as the general characteristics of the area need to be taken into account along with the presence of any features of historic, architectural, cultural or similar interest and the public safety should consider the safety of any person using a road, railway, tramway, harbour or aerodrome including the obscuration of any traffic sign or similar.
4.3 In terms of Strategic Plan Policy, the most relevant in the assessment of this particular application would be General Policy 8.
4.4 General Policy 8 states:
"Within rural areas the display of external advertisements will be permitted only where: a) they are located on or directly next to the premises to which they relate; b) they do not detract from the appearance of either the immediate area or the landscape; c) they are normally constructed of traditional materials unless the nature of the display or location would render such materials inappropriate; d) any illumination, which will be permitted only where it is essential, is kept to a minimum and is so hooded as to prevent undesirable escape of light; e) they are located so as not to cause a highway safety hazard; and f) any illumination will not have an adverse effect on areas of ecological value."
REPRESENTATIONS 5.1 Malew Parish Commissioners have stated that they have no objections to the proposal (07/02/2018).

5.2 The DOI Highway Services have indicated that there is no highways interest in the application (02/03/2018).
ASSESSMENT 6.1 The existing building already has approval for small scale commercial and tourist use. The current application does not to seek to alter this arrangement, but solely to install signage relating to the veterinary use of the premises.
6.2 The signs are not fitted with any source of illumination ensuring no light pollution in this sensitive area. The proposed signage does not impede on any visibility splays for the accesses nor is it located to cause a highway safety hazard. The omission of lighting prevents glare or visual distraction to passing traffic especially at night. Each of the signs are considered to be appropriately sized and sympathetically designed as to not detract from the character or appearance of the countryside location.
CONCLUSION 7.1 The proposed signage is considered to be of a high standard of design and appropriate to the countryside setting of the site. The proposed signs relate to the building on which they are to be displayed and are not to cause a highway safety hazard or detriment public safety.
INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013 (Article 6(4), the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material (d) Highway Services Division of Department of Infrastructure and (e) The local authority in whose district the land the subject of the application is situated.
8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed in Article 6(4) who should be given Interested Person Status. __
