This application has been recommended for approval for the following reason. The planning application accords with the provisions set out in Environment Policy 1, 2 & 34 of the Isle of Man Strategic Plan 2016, specifically as it would preserve and protect the existing stain glass windows and have an acceptable visual appearance to the building/area as such the planning application is recommended for approval.

THE APPLICATION SITE
1.1 The site is part of St. James' Church situated in the heart of Dalby. The church is used for a variety of community purposes and is known as St. James' Community Hub. The building has a number of floors, the basement, which has its own front entrance on the southern elevation and a second entrance on the northern side, was originally the school master's home when the building was consecrated in 1839 as a church and school.
THE PROPOSAL
2.1 The current planning application seeks retrospective approval for the installation of new window frames which encapsulate the existing stain glass windows with double glazed panels to either side. The existing stain glass windows has be retained.
PLANNING HISTORY
3.1 There is one previous application which is relevant in the assessment of the application, PA19/01335/B - Installation of replacement windows to front elevation - Permitted.
PLANNING POLICY
4.1 The site lies within an area zoned as "Not for Development" and within an "Area of High Landscape Value and Scenic Significance" on the 1982 Development Plan. The site is not situated within a Conservation Area nor a Flood Risk Zone.
4.2 Generally there is a presumption against development within the countryside, as per Environment Policy 1, and specifically that development within Areas of High Landscape Value and Scenic Significance does not harm the character and quality of the landscape/ the location of the development is essential, as per Environment Policy 2.
4.3 It is also noted that in the instance of St James Church as it has been identified as a site worthy of consideration for Registration that Environment Policy 34 is assessed against the application which seeks that traditional materials are preferred in pre-1920 buildings.
REPRESENTATIONS
5.1 The following representations can be found in full online, below is a short summery;

5.3 No comments have been received by Patrick Commissioners at the time of writing this report.
ASSESSMENT
6.1 The application seeks retrospective approval for the installation of window frames and double glazing panels, with the existing stained glass being encapsulated. As such the main issue is whether the works would impact the character and appearance of the property or the surrounding streetscene.
6.2 The previous application PA19/01335/B was for the installation of two windows, via the same method, which was approved. Having done a site visit it can be seen that the windows within this application were done at the same time as the windows approved under PA19/01335/B.

6.3 The officer's site visit showed that all the windows proposed within this application have the stained glass encapsulated, which whilst appearing more flat than when compared to a direct stained glass window, does ensure that the stained glass is retained and protected for the future, whilst also improving the energy efficiency of the building. This is in turn will help reduce cost of maintaining the building and also be beneficial for its long term use.
CONCLUSION
7.1 Overall it is concluded that the planning application accords with the provisions set out in Environment Policy 1, 2 & 34 of the Isle of Man Strategic Plan 2016, specifically as it would preserve and protect the existing stain glass windows and have an acceptable visual appearance to the building/area as such the planning application is recommended for approval.
INTERESTED PERSON STATUS
8.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons: (a) the applicant (including an agent acting on their behalf); (b) any Government Department that has made written representations that the Department considers material; (c) the Highways Division of the Department of Infrastructure; (d) Manx National Heritage where it has made written representations that the Department considers material; (e) Manx Utilities where it has made written representations that the Department considers material; (f) the local authority in whose district the land the subject of the application is situated; and (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material.
8.2 The decision maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed above who should be given Interested Person Status __
