C 1. The advertisement(s) hereby granted consent shall be begun before the expiration of four years from the date of this notice.
Reason: To avoid the accumulation of unimplemented advertisement consents.
This application has been recommended for approval for the following reason. The application is in accordance with section 16 of the Town and Country Act 1999 as the setting of the registered building is being preserved. The application is also judged to meet the tests of planning policy statement 1/01 as well as general policy 2 and strategic policy 4 of the IOM Strategic Plan 2016 as the setting of the registered building is being protected, and the character of the surrounding area is being respected. Whilst non-traditional materials are proposed for the signage, the proposal is judged to be acceptable in this instance as the design is sympathetic and appropriate to the building and locality. The application deemed to be acceptable.

Officer’s Report
1.0 THE SITE
1.1 The site is the grounds of Sulby Methodist Church, Lezayre. Sulby Methodist Church is a registered building (RB 172).
2.0 THE PROPOSAL
2.1 This application seeks express consent to erect an aluminium notice board to replace an existing timber notice board. The notice board would sit 1m above ground level on two support legs, and be 900mm high by 1.05m wide. The notice board is proposed to be sited in a more prominent position than the existing board, within the church yard and adjacent to the footpath and pedestrian access to the church near to the site's western boundary.
3.0 PLANNING POLICY
3.1 The site lies within an area defined as Worship on the Sulby Local Plan 1998. The site is not in an area at risk of flooding.
3.2 TOWN AND COUNTRY PLANNING ACT 1999
S16 Registered buildings: supplementary provisions (3) In considering - (b) whether to grant registered building consent for any works, the relevant Department shall have special regard to the desirability of preserving the building or its setting or any features of special architectural or historic interest which it possesses.
3.3 National policy: THE ISLE OF MAN STRATEGIC PLAN 2016
General Policy 2: Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development: (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them; (c) does not affect adversely the character of the surrounding landscape or townscape; and (g) does not affect adversely the amenity of local residents or the character of the locality.
Strategic Policy 4: Proposals for development must: (a) Protect or enhance the fabric and setting of Ancient Monuments, Registered Buildings(1), Conservation Areas(2), buildings and structures within National Heritage Areas and sites of archaeological interest;
3.4 Town and Country Planning (Control of Advertisements) Regulations 2013
(a) in the case of amenity, the general characteristics of the locality, including the presence of any feature of historic, architectural, cultural or similar interest, disregarding, if they think fit, any advertisement being displayed there; (b) in the case of public safety - (i) the safety of any person who may use any road, railway, tramway, harbour or aerodrome; and (ii) whether any display of advertisements is likely to obscure or hinder the ready interpretation of, any traffic sign, railway or tramway signal or aid to navigation by water or air.

4.0 PLANNING HISTORY
4.1 There are numerous historic applications within the curtilage of the church. None of these are judged to be relevant to the current express consent application for a replacement noticeboard.
5.0 REPRESENTATIONS
5.1 The Department of Infrastructure Highways Division - After reviewing this Application, Highway Services HDC finds it to have no significant negative impact upon highway safety, network functionality and/or parking (13.10.2023).
5.2 The Department of Infrastructure Public Transport Division have stated that they have no concerns with the application (11.10.2023).
5.3 Lezayre Parish Commissioners have stated that they approve the application unanimously (3.11.2023).
6.0 ASSESSMENT
6.1 The pertinent issue with regard to this application is the impact that the proposed signage would have on the amenity and public safety of the locality and setting of the registered building.
6.2 The proposed signage would be sited in a more prominent existing notice board. The proposed position would be more easily viewed from the road junction and by those walking along the footpath towards the adjacent primary school. The proposed size and design of the noticeboard is considered to be appropriate, and with this in mind it is considered that the proposed position would not have any adverse impact on the setting of the registered building, or the amenity of the surrounding townscape. Although the proposed notice board would be painted aluminium and not therefore a traditional material, the overall design is considered to be generally ecclesiastical, and to be appropriate in terms of its style, form and size. With this in mind, the signage is considered to preserve the setting of the registered building, and to not affect adversely the amenity of the locality.
7.0 CONCLUSION
7.1 The application is judged to be in accordance with section 16 of the Town and Country Act 1999 as the setting of the registered building is being preserved. The application is also judged to meet the tests of planning policy statement 1/01 as well as general policy 2 and strategic policy 4 of the IOM Strategic Plan 2016 as the setting of the registered building is being protected, and the character of the surrounding area is being respected. Whilst non-traditional materials are proposed for the signage, the proposal is judged to be acceptable in this instance as the design is sympathetic and appropriate to the building and locality. The application is therefore recommended for approval.
8.0 INTERESTED PERSONS STATUS
8.1 By virtue of the Town and Country Planning (Control of Advertisements) Regulations 2013, the following persons are automatically interested persons: (a) The applicant, or if there is one, the applicant's agent; (b) any Government Department that has made written submissions relating to planning considerations with respect to the application (whether pursuant to a notice under regulation 10 or otherwise) that the Department considers material;

(c) the local authority in whose district the land the subject of the application is situated; and (d) the Highways, Ports and Railways divisions of the Department of Infrastructure.
8.2 In addition to those above, the Regulation 11(3) requires the Department to decide which persons (if any) who have made written submissions with respect to the application (whether pursuant to a notice under regulation 10 or otherwise), other than those referred to in paragraph (4), should be treated as having sufficient interest in the subject matter of the application to take part in any subsequent proceedings relating to the application. __
I can confirm that this decision has been made by the Head of Development Management in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status
