Officer’s Report
1.0 THE SITE 1.1 The site is iMuseum, Kingswood Grove, Douglas.
1.2 There is a signage for the direction of the Manx Museum entrance, it is currently attached to the south elevation of 15 Kingswood Grove.
1.3 The site boundary alone Kingswood Grove (front boundary) is formed by a short stone wall with railing on top.
2.0 The PROPOSAL 2.1 The proposed is the relocation of a non-illuminative signage and the installation of a new signage.
2.2 The signage to be relocated is the direction for Manx Museum entrance.
2.3 The new signage is for the Isle of Man Family History Society. The signage is to be attached to the front boundary railing. The signage include its logo, title opening hours, slogan and website. The background is white and the words and logo uses a green and black colour scheme.
3.0 PLANNING HISTORY 3.1 Relocation of existing wall mounted signage as a freestanding sign was APPROVED under PA 18/01049/D. The proposal is basically identical to the current application but the approval has expired.
4.0 PLANNING POLICY Site Specific 4.1 The site is within an area designated as Predominantly Residential in the Area Plan for the East.
4.2 The site is within the Windsor Road Conservation Area.
Strategic Policy 4.3 The Isle of Man Strategic Plan 2016 contains the following policies that are considered materially relevant to the assessment of this current planning application: o Strategic Policy 3, 4 (a), 5 o General Policy 2 (b) (c) (g) (i) (m) (n) o General Policy 6, 37 o Environment Policy 36, 38 o Community Policy 7
/PPS and NPD 4.4 There is no planning policy statement or national policy directive that are considered materially relevant to this application.
5.0 OTHER MATERIAL CONSIDERATIONS

Legislation 5.1 Regulation 5 of the Town and Country Planning (Control of Advertisement) Regulations 2013 states that the control of advertisement is only in the interest of amenity and public safety, in particular general characteristics of the locality, the safety of any person who may use the highway and potential obscuration of any traffic sign or signals.
5.2 Section 18(4) of the Town and Country Planning Act (1999) states, "(4) Where any area is for the time being a conservation area, special attention shall be paid to the desirability of preserving or enhancing its character or appearance in the exercise, with respect to any buildings or other land in the area, of any powers under this Act". This sets out the approach to be taken in determining planning applications, which includes giving great weight to the asset's conservation when considering the impact of a proposed development on the asset. Given that the site is within a Conservation Area, the above requirements apply and appropriate consideration will be given in section 7.
6.0 REPRESENTATION 6.1 Douglas Borough Council has no objection this application (20.10.2023).
6.2 DoI Highway Services states there is no highway interest in this application (13.10.2023).
7.0 ASSESSMENT Elements of Assessment 7.1 The key considerations in the determination of the application are its impact on the character and appearance of the Area and on the neighbouring amenities.
7.2 The advertisement relates to the Manx Museum and iMuseum and they are considered to be reasonable. The signage are considered to fit within the building itself and character of the area.
8.0 CONCLUSION 8.1 The proposal is considered to comply with General Policy 2, Environment Policy 35, Environment Policy 37 of the Strategic Plan. Therefore, it is recommended for an approval.
9.0 INTERESTED PERSON STATUS 9.1 By virtue of the Town and Country Planning (Control of Advertisements) Regulations 2013 (As Amended), the following persons are automatically interested persons: o The applicant, or if there is one, the applicant's agent; o Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material; o The local authority in whose district the land which the subject of the application is situated. o the Highways, Ports and Railways divisions of the Department of Infrastructure.
9.2 The decision-maker must determine: o whether any other comments from Government Departments (other than those explicitly listed above) are material; and o whether there are other persons to those listed above who should be given Interested Person Status. __
I can confirm that this decision has been made by the Head of Development Management in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status
