C 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
C 2. The conversion stable building to home office hereby approved shall only be used in association with the main dwelling house "Goldies Loughan" and for purposes incidental to the use of main dwelling house "Goldies Loughan" as a single dwelling for no commercial purposes and only in accordance with the internal layout shown on plan 03 REV A received on the 11.07.2023.
Reason: To ensure that the proposal remains available to meet the identified need associated with Goldies Loughan; avoiding any future fragmentation of the curtilage and being used separately from the main dwelling house which would result in an unacceptable impact upon living amenities to the main dwelling house "Goldies Loughan".
This application has been recommended for approval for the following reason. The proposal is in close proximity to an existing dwelling in the countryside. The proposal would maintain the traditional form of the building and has no impact on the character of the area and neighbouring amenities.
Plans/Drawings/Information; This approval relates to the documents, topographical survey, photos and drawing no. 01, 02 which have been received on 6th April 2023, and drawing no. 03 Rev A, 04 Rev A which have been received on 11th July 2023.

THE PLANNING APPLICATION IS BEFORE THE PLANNING COMMITTEE AS THE PROPOSAL COULD BE CONSIDER CONTRARY TO THE DEVELOPMENT PLAN BUT RECOMMEND FOR AN APPROVAL
1.0 THE SITE 1.1 The application site is Goldies Loughan, Jurby East. It is located to the south of Bretney Road.
2.0 THE PROPOSAL 2.1 The proposed is the conversion of existing stable into a home office. The proposal will increase the height of the roof, add rooflights and new windows and install a flue.
3.0 PLANNING HISTORY 3.1 Erection of a single storey sun room extension to rear of dwelling was APPROVED under PA 05/01058/B.
4.0 PLANNING POLICY Site Specific 4.1 The site is not within an area designated for a specific land use. Therefore, it is considered to be part of the countryside.

5.0 OTHER MATERIAL CONSIDERATIONS Strategy and Guidance 5.1 There is no strategy or guidance considered to be materially relevant to this application.
6.0 REPRESENTATIONS 6.1 Jurby Parish Commissioners has not commented at the time of the report (17.07.2023).
6.2 DoI Highway Services does not object to this application (19.04.2023). The comment states that there is no significant negative impact upon highway safety, network functionality and /or parking.

7.1 The key considerations of this application are its principal, its impact the character and streetscene of the area and on neighbouring amenities
Principal of the Development 7.2 The proposed is conversion of a stable into a home office, which can been seen as part of the main dwelling. This means the application will be assessed against the criteria for conversion of an existing rural building to a dwelling. This being said, the proposal will be limited to use incidental to the enjoyment of the main dwelling as it is the use the applicant is seeking for.
7.3 The redundancy of the stable use can be established as photos provided by the applicant shows the stable has been surrounded by domestic items and there are no horses stationed inside the stable. The photo also show the stable is structurally intact as the walls and the roof are holding. The building is of architectural interest as it of traditional form. It is large enough to accommodate a home office without the need to extend the building horizontally. The use would be compatible with the surrounding residential use and can be connected to existing utilities of the main dwelling. In summary, while there is not specific planning policy which relates the conversion of rural building to home offices, it is considered the proposal would comply with the aims of Housing Policy 11 and Environment Policy 16 which seek the re use of appropriate rural buildings for alternative uses. Therefore it is considered the principal of the proposal is acceptable.
Character and Street Scene 7.4 As the alteration to the building still maintains its traditional form and the additional glazing and flue does not make the building appears overly-domestic, it is considered that there is no impact on the character of the area.
Neighbouring Amenities 7.5 It is considered that there is no impact on neighbouring amenities, given its proposed use as a home office in connection with the main dwellinghouse Goldies Loughan.
8.0 CONCLUSION 8.1 The proposal is in close proximity to an existing dwelling in the countryside, albeit incidental use with the dwelling Goldies Loughan. The proposal would maintain the traditional form of the building and has no impact on the character of the area and neighbouring amenities. Therefore, it is recommended for an approval.
9.0 INTEREST PERSON STATUS 9.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons: (a) the applicant (including an agent acting on their behalf); (b) any Government Department that has made written representations that the Department considers material; (c) the Highways Division of the Department of Infrastructure; (d) Manx National Heritage where it has made written representations that the Department considers material; (e) Manx Utilities where it has made written representations that the Department considers material; (f) the local authority in whose district the land which the subject of the application is situated; and (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material.
9.2 The decision-maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and
