C 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
C 2. The Air Source Heat Pump must be installed according to the plans and supporting information and must be maintained as such thereafter.
Reason: To ensure the development is implemented according to the plan submitted and in the interest of protecting amenities of neighbouring property.
C 3. The only model of Air Source Heat Pump that shall be installed is the Ecodan Monobloc Standalone PUZ-WM112VAA(-BS) Ecodan R32.

Officer’s Report
1.0 THE SITE 1.1 The site is the residential curtilage of Regent House, Upper Cronk Orry, Laxey, a detached house located on the southwest of Upper Cronk Orry.
2.0 THE PROPOSAL 2.1 The application seeks approval for the installation of two Air Source Heat Pumps (ASHP) at the west of the house.
2.2 The sound power level of the air source heat pump provided by the product specifications submitted is 60dB. The noise assessment position is related to a side window of Gretch Veg, west of the site. The measured distance from the heat pump to the assessment position is 20m.
3.0 PLANNING HISTORY 3.1 There is no previous application considered materially relevant to this application.
4.0 PLANNING POLICY Site Specific 4.1 The site is within an area designated as Predominantly Residential in the Area Plan for the East.
Strategic Policy 4.2 The Isle of Man Strategic Plan 2016 contains the following policies that are considered materially relevant to the assessment of this current planning application: o Paragraph 3.2 o General Policy 2 (b) (c) (g) (n) o Environment Policy 22 o Paragraph 12.2.8 o Energy Policy 4 o Community Policy 7, 10 and 11

5.0 OTHER MATERIAL CONSIDERATIONS 5.1 There is no relevant strategy or guidance for this application.
6.0 REPRESENTATIONS 6.1 Garff Commissioners has no objection on this application (14.04.2023).
6.2 DoI Highway Services states there is no highway interest in this application (05.04.2023).

7.0 ASSESSMENT Elements of the Assessment 7.1 The key consideration of this application is its impact on the amenities of the neighbouring property.
7.2 The proposed ASHP is promoting the reduction in consumption of fossil fuels and therefore positively contributes to Strategic Policy 5 and should be encouraged. The ASHP generally has higher energy efficiency than typical modern boilers and therefore also fits in General Policy 2 (n).
7.3 According to Environment Policy 23, the addition of noise is a material consideration. The units would be located on the north corner of the site and would be approx. 4m away from the closest neighbouring boundary. Accordingly, the proposal may have some impact on neighbouring property.
7.4 In terms of noise impact, the assessment is conducted under MCS 020 Planning Standards for permitted development installations of wind turbines and air source heat pumps on domestic premises. This standard has been approved by the Steering Group of the Microgeneration Certification Scheme. It was prepared by MCS, Defra (UK), DECC (UK) and DCLG (UK). It is a compulsory standard for ASHP to be Permitted Development in the UK. The standard set a 42dB or under at the assessment position as an acceptable level of noise. This is compared to a background noise level of 40dB.
7.5 Under this assessment, the noise level is considered to be 41dB, which is under the 42dB limit. The assessment for the ASHP closer to the corner is also 41dB. Therefore, the noise impact is considered to be acceptable.
7.6 Compare to one installation, two ASHPs present the problem of sound wave interference. However, given the short period of the operation mechanism, it is considered that this variation would not drastically change the assessment and is considered acceptable.
7.7 The ASHPs are not readily visible to the public and therefore has no impact on the character of the area.
Summary 7.8 There is no negative impact created by the proposal and the air source heat pump is promoting sustainable development.
8.0 CONCLUSION 8.1 The proposal is considered to comply with General Policy 2, Environment Policy 22 and Energy Policy 4 of the Strategic Plan. Therefore, it is recommended for an approval.
9.0 INTEREST PERSON STATUS 9.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons: (a) the applicant (including an agent acting on their behalf); (b) any Government Department that has made written representations that the Department considers material; (c) the Highways Division of the Department of Infrastructure; (d) Manx National Heritage where it has made written representations that the Department considers material; (e) Manx Utilities where it has made written representations that the Department considers material; (f) the local authority in whose district the land which the subject of the application is situated; and

9.2 The decision-maker must determine: o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and o whether there are other persons to those listed above who should be given Interested Person Status. __
