1.1 The site is the residential curtilage of an existing dwelling situated on the south eastern side of The Crofts. The dwelling is stone faced, three storey house attached on the north eastern side to 8, The Crofts which in turn is attached on the other side to number 9. The three dwellings form a handsome terrace with matching fenestration on the second and first floors but with numbers 7 and 9 having angled bays at ground floor level whereas the central dwelling has a simpler, smaller slated roofed bay. - 1.2 The application property has a lean to garage to the right behind which is a flat roofed extension with a lantern light. THE PROPOSAL

2.1 Proposed is the replacement of the lantern light to match the existing and the replacement of the existing rear windows and doors with five patio/bifold doors. PLANNING POLICY - 3.1 The site lies within an area designated on the Area Plan for the South as Residential and within the town's Conservation Area.

3.2 As such, the following policies are considered relevant:

General Policy 2 which requires, inter alia, that development respects the character and appearance of the area and the living conditions of those in adjacent properties.

General Policy 34 which states a preference in pre-1920s buildings for traditional materials in their alteration, extension or maintenance.

Environment Policy 35 and Planning Policy Statement 1/01 CA/2 which require development to preserve or enhance the character or appearance of the area.

## PLANNING HISTORY

4.1 The existing rear annex was approved under 10/00774/B. REPRESENTATIONS - 5.1 Highway Services have no highway interest in the application (09.07.20). ASSESSMENT - 6.1 The issue in this case is whether the replacement doors and lantern light preserve or enhance the character or appearance of the Conservation Area and whether there would be any adverse impact on the living conditions of those in nearby dwellings.

6.2 The proposed replacement lantern light will be the same as the existing and will therefore have a neutral impact on the character and appearance of the area and the living conditions of those in nearby dwellings. - 6.3 The new doors will not afford any greater view than do the existing windows and doors and they are within a modern annex which is not publicly visible so will not adversely affect the character or appearance of the Conservation Area and is not considered to be in conflict with EP34.

## CONCLUSION

7.1 It is considered that the development accords with General Policy 2 and Environment Policy 35 of the Strategic Plan as well as CA/2 of Planning Policy Statement 1/01 and is supported. INTERESTED PERSON STATUS - 8.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons:

- (a) the applicant (including an agent acting on their behalf);
- (b) any Government Department that has made written representations that the Department considers material;
- (c) the Highways Division of the Department of Infrastructure;
- (d) Manx National Heritage where it has made written representations that the Department considers material;
- (e) Manx Utilities where it has made written representations that the Department considers material;
- (f) the local authority in whose district the land the subject of the application is situated; and
- (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material. 8.2 The decision maker must determine:

- o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and
- o whether there are other persons to those listed in Article 4(2) who should be given Interested Person Status.
