TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013

In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Mrs Linzi Michelle Brown, Ref 18/00628/B, for the Removal of condition 3 of application 17/00851/C, to remove the restrictions in respect of days and hours of operation at The Switzerland Gospel Hall Switzerland Road Douglas Isle Of Man IM2 4NG subject to compliance with the following condition(s) and notes (if any):

- 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.

Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.

- 2. For the avoidance of doubt, the use hereby approved shall be limited to that of a dance studio.

Reason: Any materially different uses may have different impacts that will require fresh assessment as to their impact on the living conditions of neighbours.

- 3. Prior to the implementation of the approval hereby given, the car park shall be marked out in accordance with details which have first been approved in writing by the Department and show spaces and vehicle manoeuvring room. The car park shall be marked out in accordance with the approved details and retained as such thereafter.

Reason: To maximise the use of the car park and to discourage additional on-street parking to benefit other users of the public highway, albeit with spaces which may be below the current standards as set out in the Manual for Manx Roads.

- 4. No customers shall remain in the building or within the site outside the hours of 8:30 to 21:00 on any day.

Reason: In order to protect local residents' amenity in terms of noise or any other disturbance that may arise from additional classes. This condition does not restrict the building being accessed by staff and is not intended to restrict the carrying out of related activities (such as cleaning) at other times.

This approval relates to the following plans/drawings/informations:

- - Location plan date stamped as having been recieved 14th June 2018;
- - Internal layout plan date stamped as having been received 14th June 2018;
- - Supporting statement date stamped as having been received 14th June 2018;
- - Additional Information comprising e-mail from L. Brown dated 09/08/18 (08:49) and four attached photographs; and
- - Additional Information comprising e-mail from L. Brown dated 30/07/18 (23:07 and two attached messages and 8 attached photographs.

Any appeal against this decision must be in accordance with the criteria set down in that instrument.

Specifically, a valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain:

-  Payment of a planning appeal fee as prescribed in the Town and Country Planning (Application and Appeal Fees) (No2) Order 2016 (currently £175);
-  The reasons for making the appeal; and
-  An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.
