Reason: To protect the existing residential amenity and enjoyment of Walton House and to prevent use of the building as a permanent, independent dwellinghouse.

Officer’s Report THE SITE

1.1 Walton House is a large, two-storey detached dwelling located on the south-eastern side of Bridge Road in Ballasalla. - 1.2 As well as Walton House itself, the site also contains a detached, two-storey building comprising ancillary accommodation and a garage with storage above. It is the ancillary accommodation building that is the subject of this and the previous planning permission 16/00850/B. THE PROPOSAL

2.1 The proposal consists of retrospective amendments to works constructed under PA 16/00850/B. The alterations relate to window types and positions including the exchanging the two windows on the front (east) elevation for one larger window; exchanging the high-level window on the side (south) elevation for a set of patio doors; the inclusion of a new window on the side (north) elevation; and exchanging the patio doors on the rear (west) elevation for a window. PLANNING POLICY - 3.1 The site is within an area zoned as Predominantly Residential, and also within a proposed Conservation Area, under the Area Plan for the South 2013. As such, it is considered appropriate to reflect on the relevant parts of General Policy 2 and Environment Policy 35 of the Strategic Plan.

3.2 Within chapter 8 of the Strategic Plan, paragraph 8.12.1, in relation to extensions to Dwellings in built up areas or sites designated for residential use, it states 'As a general policy, in built up areas not controlled by Conservation Area or Registered Building policies, there will be a general presumption in favour of extensions to existing property where such extensions would not have an adverse impact on either adjacent property or the surrounding area in general'. PLANNING HISTORY - 4.1 The previous planning application 16/00850/B for the alteration and erection of extension to existing detached ancillary living accommodation is considered to be specifically material in the assessment of the current application. REPRESENTATIONS - 5.1 Representation from the Department of Infrastructure (DOI) Highways Division confirms that there is no highways interest in the letter dated 02 March 2018.

5.2 Malew Parish Commissioners have commented on this application and stated that they do not object in the email dated 08 March 2018. ASSESSMENT - 6.1 This application has been made to facilitate amendments to the planning permission 16/00850/B; therefore only these alterations have been considered and other issues, such as the redline boundary, have not.

6.2 The alterations are minor and most of them are not be visible from the highway. A new window has been added on the north elevation; however this is small and located at the ground floor level.

6.3 The new window on the side (north) elevation faces onto the existing parking area and towards the highway and the new window in the rear (west) elevation replaces a set of patio

doors from the previous planning permission. Therefore the amendments are not considered to have any greater impact than the previous approved scheme.

## CONCLUSION

7.1 The proposal would not unacceptably harm the characteristics of the existing building or the character of its surrounding and the proposed development would not result in a significant adverse impact upon the living conditions of neighbouring residents. The proposal therefore complies with General Policy 2. INTERESTED PERSON STATUS - 8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013 Article 6(4), the following persons are automatically interested persons:

- (a) The applicant, or if there is one, the applicant's agent;
- (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested;
- (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material
- (d) Highway Services Division of Department of Infrastructure and
- (e) The local authority in whose district the land the subject of the application is situated. 8.2 The decision maker must determine:

- o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and
- o whether there are other persons to those listed in Article 6(4) who should be given Interested Person Status.
