I was not aware of this property but one of my team has been to visit and they believe from a quality perspective that the 'apartment' is of good quality in relation to our common standards. However, within our legislation if a property does not have the correct planning use to be used as tourist accommodation we wouldn't be able to register it officially.

In order for us to officially register a property such as this, it would need to meet minimum standards as well as all other agency requirements:

1. Planning
2. Building control
3. Fire
4. Where necessary EHO
5. Have public liability in place to a minimum of

Once all of the above is met along with the minimum standards we can register the property. They would then receive an independent assessment which is when the official star rating is awarded.

Hope you are well?
I have a general tourism related question, but also relates to the above current application which is a good example. The above application, I have concerns that the use of the lower ground floor of the dwelling for tourist use. I believe the outlook/amenity value is poor, essentially having two small windows serving the lounge/main living space, overlooking a driveway and neighbouring property only. The other three small windows serve a porch and toilet. Is there anything in tourisms legislation which would prevent a unit being used for tourist purpose, because you thought it wasn't good enough?

Is this type of tourist unit something we want to encourage? Certainly, if they were seeking approval of the lower floor for a permeant apartment, we would refuse it on the grounds that it did have a clear and pleasant outlook and poor amenities. That being the case this brings me back to the question that if it is not acceptable for permeant accommodation should we be allowing tourist use also?
