This application has been recommended for approval for the following reason. The application complies with both General Policy 2 and Environment Policy 35 of the Isle of Man Strategic Plan 2016.

1.1 The application site is the Manx Electric Railway Goods Shed which is situated to the west of Captains Hill and the east of New Road in the centre of Laxey Village.

1.2 The Goods Shed itself is situated just outside the main transport hub of the Manx Electric Railway and within a public views from both New Road and Captains Hill. To the east and south of the shed there is a car park which is used for the Manx Tavern. - 1.3 The shed comprises a number of large windows along its longest elevations. At one gable end is a large access door and a small window, and the other end is a small access door, a plastic sheet window and a louvre/vent in the peak. THE PROPOSAL

2.1 The current planning application seeks approval for the replacement of the smaller gable door with a larger door, the installation of a window in place of the old plastic sheet and for the installation of a second louvre/vent in the opposite gable peak. PLANNING HISTORY - 3.1 There are have been a number of previous applications across the wider Manx Electric Railway site, most recently the goods shed had replacement windows approved under 20/00536/B. PLANNING POLICY - 4.1 The site lies within an area zoned as 'Mixed Use' on the Area Plan for the East 2020 and alongside the designated 'railway' route of the MER trams. The site is also within the designated Laxey Conservation Area. As such the most relevant policies would be General Policy 2 which sets out the general standards towards acceptable development, as well as Environment Policy 35 which seeks to preserve or enhance the character of the Conversation Area.

5.2 Department of Infrastructure Highway Services - No highways interest (10/02/2022) - 5.3 No comments received from neighbouring properties.

## ASSESSMENT

6.1 The works to the building would result in a larger access door matching that on the adjacent side of the building, and would see the installation of a new window and louvre/vent also in keeping with the overall character, appearance and style of the building and which are likely to help with the continued use, preservation and function of the goods shed. The proposal is considered to have an acceptable visual, amenity and Conservation impact and meets the tests of both General Policy 2 and Environment Policy 35. CONCLUSION - 7.1 The application complies with both General Policy 2 and Environment Policy 35 of the Isle of Man Strategic Plan 2016 and recommended for approval. INTERESTED PERSON STATUS - 8.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons:

- (a) the applicant (including an agent acting on their behalf);
- (b) any Government Department that has made written representations that the Department considers material;
- (c) the Highways Division of the Department of Infrastructure;

- (d) Manx National Heritage where it has made written representations that the Department considers material;
- (e) Manx Utilities where it has made written representations that the Department considers material;
- (f) the local authority in whose district the land the subject of the application is situated; and
- (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material. 8.2 The decision maker must determine:

- o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and
- o whether there are other persons to those listed above who should be given Interested Person Status
