The creation of the access has been stated as for occasional use, and from photographs provided appears to be required for access to an area of storage, as oppose to an additional access to a dwelling which is contrary to Department policy.

The creation of a direct access onto the highway has specific design criteria, which can be found in Manual for Manx Roads. This criteria includes: a minimum width of 3.1m, entry splays of 2m x 2m, a bound and consolidated surface material for a minimum of 6m from the highway and for gates to be setback 6m from the highway.

From the photographs provided, the access appears to meet the minimum width requirement. However, all other criteria have not been met. There are no entry splays provided, the surface type has remained grass/soil so increases the risk of loose material being brought onto the highway, and the gate is only setback approximately 1m from the highway.

Additionally, no visibility splays have been provided for the new access. The alteration to the highway, in the form of creating a new access, requires a Section 109(A) Highway Agreement to be complete post planning consent. The Applicant shall provide run off / surface water drainage where necessary to prevent water from flowing out onto or damaging the public road, such as where a driveway slopes down towards the road. Similarly, on construction of the vehicular access, the existing road drainage must either be retained or an effective alternative scheme provided at the Applicant’s expense on a satisfactory arrangement being drawn up and agreed with the Highway Services’ Drainage team. Highway Services request the following revisions/additional information to be provided:

- • A visibility splay drawing showing the achievable visibility from a 2.4m setback distance;
- • An access drawing showing the width of the access proposed, with appropriate entry splays, a bound and consolidated surface and gates setback 6m from the highway.
