## Officer’s Report

1.0 THE SITE - 1.1 The application site as defined in red represents the footprint of part of an existing building that lies within the larger complex of buildings centred around Darnill's petrol station on Station Road in Port Erin. Two independent retails units form the application site, while a lobby to the front of Unit 2 has been excluded from the site for some reason. - 1.2 The complex includes the filling station and associated grocery store and garaging, as well as a computer repair shop and a café. It lies just outwith the Proposed Conservation Area for the village.

2.0 THE PROPOSAL - 2.1 Express consent is sought to erect a sign above both Units 1 and 2, which, under a separate application (PA 15/00796/B - see below for more details), is sought to be used as a single pharmacy. - 2.2 The signage would be 8000mm in width by 1000mm in height and would be internally illuminated. The signage would carry the lettering of the business ("clearpharmacy"), with "clear" appearing in a light blue and "pharmacy" being very dark grey, as well as two logos, each formed of five circles arranged in the shape of a cross. The circles would be of the same blue as the lettering for "clear". The sign itself would be of a much lighter grey, 10mm in thickness. This would be fret cut to accept the new lettering, around which the illumination would 'escape'.

3.0 PLANNING HISTORY - 3.1 PA 15/00796/B seeks approval for the conversion of the two retail units into a single unit, from which a pharmacy would operate. The two applications were submitted concurrently and so no decision has yet been issued with respect to PA 15/00796/B. - 3.2 The application has been the subject of a number of historic proposals, both for development and advertisements, but none of these is considered specifically materials to the determination of the current application.

4.0 THE DEVELOPMENT PLAN - 4.1 The site lies within an area designated as 'Mixed Use' in the Area Plan for the South (Map 7), but is not specifically zoned as or for any specific mix of uses. With this in mind, it is considered that General Policy 6 of the Strategic Plan is of most relevance.

5.0 REPRESENTATIONS - 5.1 Port Erin Commissioners indicate that they do not object to the application (05.08.15). - 5.2 Department of Infrastructure Highway Services indicate that they do not object to the application (04.08.15).

6.0 ASSESSMENT - 6.1 The signage would not be out of keeping with an area that is commercial in nature. While it is large, it fills an existing fascia and would replace a pair of smaller signs of different sizes that do not contribute especially positively to the visual amenity of the site. It would therefore be of a size appropriate to the site and relative to its surroundings. - 6.2 The proposed method of illumination would be subtle and well-considered, and would also not result in a highway safety issue or have any significant negative impacts on nearby residents. However, a condition requiring the signage to be illuminated from a nonintermittent source is recommended to prevent any flashing, which might harm the living conditions of those residing in the flats above the shops opposite the application site. - 6.3 It is not considered that the proposal conflicts with any of the provisions of General Policy 6 of the Strategic Plan, and it is therefore concluded that the consent should be issued.

7.0 INTERESTED PERSON STATUS - 7.1 By virtue of the Town and Country Planning (Control of Advertisements) Regulations 2013, the following persons are automatically interested persons:

- (a) The applicant, or if there is one, the applicant's agent;
- (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested;
- (c) Persons to whom notice has been given under Regulation 10(3)(a)(i);
- (d) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material;
- (e) The Highways Division of the Department of Infrastructure;
- (f) The Ports Division of the Department of Infrastructure;
- (g) The operator of the railway or tramway, and
- (h) The Local Authority in whose district the land the subject of the application is situated.
