I refer to the appeal in respect of the above planning application.

In accordance with the provisions of the Town and Country Planning (Development Procedure) (No 2) Order 2013, I herewith give notice of the appeal decision.

The Minister for Environment, Food and Agriculture, the Hon R A Ronan MHK, has considered the report, concurs with the appointed person's conclusions, and accepts the recommendation that the appeal should be dismissed. Accordingly, he has directed that the Department's approval of the application under Article 6 of the Town and Country Planning (Development Procedure) (No 2) Order 2013 should be upheld, and that the application should be **Approved subject to conditions**. Formal notice of this decision is attached.

## The Town And Country Planning Act 1999

### THE TOWN AND COUNTRY PLANNING (DEVELOPMENT PROCEDURE) (No2) ORDER 2013

In pursuance of his powers under the above Act and Order, the Minister for the Department of the Environment, Food and Agriculture, the Hon R A Ronan MHK does hereby in the name of and on behalf of the Department APPROVE planning application 15/00552/A by Port St Mary Commissioners for Approval in principle for a residential development with associated car park, addressing siting, means of access and landscaping - Chapel Gate Car Park and land adjacent, Bay View Road, Port St. Mary, Isle of Man subject to the following conditions:-

1. The development hereby approved shall be begun either before the expiration of four years from the date of this approval, or before the expiration of two years from the date of approval of the last of the reserved matters.

Reason: To comply with Article 14 of the Town and Country (Development Procedure) (No 2) Order 2013.
2. Approval of the details of design, external appearance and internal layout (hereinafter called "the reserved matters") shall be obtained from the Department in writing before any development is commenced.

Reason: To comply with the Town and Country Planning (Development Procedure) (No 2) Order 2013.
3. Application for approval of the reserved matters shall be made to the Department before the expiration of two years from the date of this approval and thereafter the development shall be carried out only in accordance with the details as approved.

Reason: To avoid the accumulation of unimplemented planning approvals.
4. The application for reserved matters shall include an Arboricultural Method Statement by a qualified arboriculturalist to demonstrate how the development may be practicably undertaken without adversely affecting the health of trees during and after the construction period.

Reason: In the interests of the ecology and character of the site.

5. The application for reserved matters shall include details of a lighting scheme to ensure that the proposed path and the existing access lane are suitably lit.

**Reason:** In the interests of pedestrian safety.

6. Prior to the occupation of any dwelling, the car parking and manoeuvring space associated with that dwelling shall be provided and remain free from obstruction thereafter.

**Reason:** To ensure that the car parking standards are met and to limit the use of the Chapel Gate Car Park by vehicles associated with the site's residents.
