In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Department Of Education And Children, Ref 13/90920/B, for the roof light alterations and erection of a conservatory and a decked area with ramp access within internal courtyard area at Castle Rushen High School Arbory Road Castletown Isle Of Man IM9 1RE subject to compliance with the following condition(s):

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
2. The development hereby permitted shall not be carried out except in full accordance with the following plans P01 and P02 received on 1st August 2013.

This decision was made by a Senior Planning Officer in accordance with the authority delegated to them.

This permission refers only to that required under the Town and Country Planning (Development Procedure) (No 2) Order 2013.

In accordance with Article 8 of the same Order any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

Should you wish to appeal against this decision your request must be in writing, signed by you as appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal your request must contain:

- Payment of a planning appeal fee as prescribed in an order made by the Department under Section 1(1) of the Fees and Duties Act 1989 (currently £150);
- The reasons for making the appeal; and
- An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.

## Officer's Report

### 1.0 The Site

1.1 The application site is the curtilage of Castle Rushen High School, Arbory Road, Castletown. The site is situated to the southern side of Arbory Road, the car park and sports courts are adjacent to the road with the school buildings set back behind. The entrance to the site is adjacent to the Southern Swimming Pool building. The area of the proposed works is a small grassed area which is enclosed by different classrooms within the school. This area is not visible from the outside of the school and is only visible from the classrooms which surround the grassed area.

### 2.0 The Proposal

2.1 The application seeks approval for the erection of a conservatory within the existing grassed area. The conservatory would measure approximately 5.6m x 5.615m internally. The conservatory would be constructed of uPVC and would have similar glazing sections as the glazing in the classrooms. The rest of the area would be covered with timber or vinyl decking and a ramp would be constructed at one end to provide access. Timber or vinyl fencing would be erected around the perimeter of the decking so that it would be secure. There would be galvanised steel handrails erected on either side of the ramp for safety.

### 3.0 Planning History

3.1 There have been a number of previous applications for the High School, none of which specifically relate to this site and therefore are not considered to be specifically material in the assessment of the current application.

### 4.0 Development Plan Policies

4.1 The application site is within an area zoned as "Secondary School" identified on the Area Plan for the South 2013. Given the nature of the application it is appropriate to consider General Policy 2 and Community Policy 5 of the Isle of Man Strategic Plan (20th June 2007).

### 4.2 General Policy 2

Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:

b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;
c) does not affect adversely the character of the surrounding landscape or townscape.

## 4.3 Community Policy 5

Permission will generally be given for proposals to improve or extend existing schools and institutions of high education and to build new schools, subject to their being sited and designed in accordance with the other policies of this plan, having particular regard to the potential for community use of the buildings and the associated Open Space.

#### 5.0 Consultations

5.1 Castletown Commissioners have not commented

#### 5.2 Highways Division do not oppose

#### 6.0 Assessment

6.1 The proposed extension and alterations would provide a useable, social space within the school. The proposal would not be visible from the main public thoroughfares and therefore would not have an unacceptable impact upon the character and appearance of the school or area in general.
6.2 Given that it is within the school and would not be visible from the public thoroughfare it is considered that the proposal would not have an unacceptable impact upon the amenities of neighbouring properties or the character and appearance of the street scene.
6.3 For these reasons the application is considered to be acceptable and is recommended for approval.

#### 7.0 Party Status

7.1 The local authority, Castletown Commissioners is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
7.2 The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
