In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Mr David Hyslop, Ref 13/00811/B, for the Alterations, erection of an extension, creation of vehicle entrance, driveway and parking provision at Ballachrink Farm Ballanicholas Garth Crosby Isle Of Man IM4 2HD subject to compliance with the following condition(s):

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
2. The development hereby permitted shall not be carried out except in full accordance with the following plan 2013/07 01, 2013/07 02, 2013/07 03 and 2013/07 04 received on 10th July 2013.

NOTE: no approval is hereby granted or implied to the rendering of any of the elevations of the existing dwelling.

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

## Officer's Report

1.0 THE SITE
1.1 The site represents the curtilage of Ballachrink Farm, Ballanicholas, Garth, Crosby which is an existing traditional two storey Manx Farm house property, situated to the west of a farm lane which runs approximately 420 metres to the B35 which is to the west of the site.

2.0 THE PROPOSAL
2.1 The application seeks approval of alterations, erection of an extension, creation of vehicle entrance, driveway and parking provision.
2.2 The main works involve the erection of a rear (north elevation) single storey extension, with a width of 4.5 metres, a depth of 5.5 metres and a ridge height of 3.5 metres. Further works involve the creation of a new driveway from the existing farm access, which also includes the opening up of the original dwelling access by the removal of part of the Manx stone wall which will then connect to a new parking and turning area, which would front the dwelling.

3.0 PLANNING STATUS
3.1 The site lies within an area designated as open space, not zoned for development under the Isle of Man Development Order 1982.
3.2 Due to the site location, zoning and the type of proposal, the following policy is relevant for consideration:-
3.3 Housing Policy 15 states: "The extension or alteration of existing traditionally styled properties in the countryside will normally only be approved where these respect the proportion, form and appearance of the existing property. Only exceptionally will permission be granted for extensions which measure more than 50% of the existing building in terms of floor space (measured externally)."

4.0 PLANNING HISTORY
4.1 There are no previous planning applications which are considered relevant in the assessment and determination of this application.

5.0 REPRESENTATIONS
5.1 Department of Transport Highways and Traffic Division, Drainage Division and Rushen Parish Commissioners indicate that they have no objection to the application.
5.2 Marown Parish Commissioners have no objection to the proposals.
6.0 ASSESSMENT
6.1 The application seeks approval for the alterations and extension to the property. The main issues to consider in the assessment of the application are the increase in floor area, the impacts upon the character and appearance of the property and street scene in general, and the impacts upon the amenities of local residents.
6.2 The proposed replacement extension would result in an increase in floor area by approximately sqm. This would result in an increase in floor area of approximately $8 \%$, this therefore falls under the $50 \%$ increase in floor area and complies with this part of the policy. In terms of the proportion, form, size and design of the extension, it is considered that the proposal would be in keeping with the existing property and a appropriate form of development.
6.3 It is judged that the proposed extension would respect the proportion, form and appearance of the existing dwelling and would therefore be in accordance with this part of Housing Policy 15 .
6.4 IN relation to the proposed driveway way, the new driveway would access from an existing farm access and run approximately 34 metres north to the dwelling. The proposal would result in the re-opening of the original entrance (visiting the site there was a visible difference in stonework, where the original entrance was likely to have been, albeit smaller in width than what is now proposed) and provide parking and turning provisions within the curtilage of the farmhouse. Currently, parking is to the northeast of the site, which involves driving through a working farm yard, which is perhaps not ideal.
6.5 The driveway/parking areas in their very nature are low level development, which on a relatively flat site and being a significant distance from the public highway (i.e. public views), will have little, if no impact upon the visual amenities of the countryside or upon the individual property.

## 7.0 Recommendation

7.1 For these reasons the proposals is considered to comply with the relevant polices of the Strategic Plan and therefore recommended for an approval.

#### 8.0 Party Status

8.1 It is considered that the following meet the criteria of Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d) and should be afforded interested party status:

8.2 The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
