In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to **APPROVE** a planning application by Mount Murray Country Club Limited, Ref 13/00721/B, for the Creation of six windows to west elevation of building at Mount Murray Hotel Ballacutchel Road Mount Murray Douglas Isle Of Man IM4 2HT subject to compliance with the following condition(s):

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This approval relates to the installation of new windows as shown in drawings P000 A, P001 A, P002 A, P003 A and P004 A all received on 21st June, 2013.

#### Guidance Note

This decision was made by the Development Control Manager in accordance with the authority delegated to her. This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

The proposed development must not be commenced until either;

- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.
If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department's public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.

Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.

#### The Site

1.1 The site is the curtilage of the Mount Murray Country Club and Golf Course situated on the northern side of the A5 Castletown Road and on both sides of the Ballacutchel Road: the golf course straddling the road and the hotel and tourist accommodation on the eastern side with the golf-related clubhouse and supporting facilities on the western side.

1.2 The hotel complex takes the form of a large rendered building and associated tourist accommodation, leisure and health facilities are provided within the same built complex. Planning permission has been granted for additional buildings accommodating a casino and aparthotel (PA 09/00441). Development has not yet commenced on this and an extension of time has been granted for this up to 14.10.2015.

#### The Proposal

2.1 Proposed is the installation of six new windows in the lower ground floor of the western elevation which faces Ballacutchel Road. The windows will be the same as those already in that elevation - ie vertically proportioned windows split into four - two square top hinges casements with glazing bars which divide each square into four above two clear lights.

#### Planning Status And Policy

3.1 The part of the site which accommodates the hotel complex lies within an area designated as an Area of High Landscape or Coastal Value and Scenic Significance on the Isle of Man Planning Scheme (Development Plan) Order 1982.

3.2 As such, the relevant policy to be considered is General Policy 2 as follows:

"Development which is in accordance with the land use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:

a) is in accordance with the design brief in the Area Plan where there is such a brief;
b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the space around them;
c) does not affect adversely the character of the surrounding landscape or townscape;
d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses;

e) does not affect adversely public views of the sea;
f) incorporates where possible existing topography and landscape features, particularly trees and sod banks;
g) does not affect adversely the amenity of local residents or the character of the locality;
h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space;
i) does not have an adverse effect on road safety or traffic flows on the local highways;
j) can be provided with all necessary services;
k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan;
l) is not on contaminated land or subject to unreasonable risk of erosion or flooding;
m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and
n) is designed having due regard to best practice in reducing energy consumption."

## Planning History

4.1 The site has been the subject of many applications for the creation of the hotel complex and associated facilities, much of which has been approved and implemented. None of these applications is relevant to the application in hand.

5.1 There are no representations on the file at the time of writing.

### Assessment

6.1 The windows will not be particularly visible from the adjacent highway and even whilst within the site the windows are partly screened by the natural ground level and the hand rails alongside this part of the building. In any case, the windows are complementary to the others in the elevation and will not result in any adverse impact.
6.2 As such the application is recommended for approval as it is considered to accord with the provisions of General Policy 2 of the Strategic Plan.

### Party Status

7.1 The local authority, Santon Parish Commissioners are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered "interested persons" and as such should be afforded party status.
