In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to **APPROVE** a planning application by Mr Brian Douglas Faragher, Ref 13/00702/B, for the erection of an extension to existing barn at Ballachrink Farm Old Castletown Road Santon Isle of Man IM4 1HD subject to compliance with the following condition(s):

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. The development hereby permitted shall not be carried out except in full accordance with the following plans 01, 02, 03 P5142-01 received on 18th June 2013.

This decision was made by the Director of Planning and Building Control in accordance with the authority delegated to him. This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

#### 1.0 The Site

1.1 The application site is the curtilage of Ballachrink Farm, Old Castletown Road, Santon which is situated to the northern side of the Old Castletown Road. The farm is mainly for dairy farming, there are a number of outbuildings located around the farmyard as well as the main farmhouse. There is a farm workers bungalow situated at the entrance to the farm.

#### 2.0 The Proposal

2.1 The application seeks approval for the erection of an extension to an existing agricultural building. The building is to be used for rearing heifers for the milking herd.

2.2 The building would measure approximately 18.288m x 9.144m, the upper part of the extension would have metal sheeting and would be finished to match the existing building. The roof would be constructed of single skin sheeting with rooflights, again to match the existing.

#### 3.0 Planning History

3.1 The previous applications are not considered to be specifically material in the assessment of the current application.

#### 4.0 Development Plan Policies

4.1 The application site is within an area zoned as Area of High Landscape or Coastal Value and Scenic Significance identified on the 1982 Development Plan. Given the nature of the application it is appropriate to consider General Policy 3 and Environment Policy 15 of the Isle of Man Strategic Plan (20th June 2007).

#### 4.2 General Policy 3

Development will not be permitted outside of those areas which are zoned for development on the appropriate Area Plan with the exception of:

a) Essential housing for agricultural workers who have to live close to their place of work; (Housing Policies 7, 8, 9 and 10);
b) Conversion of redundant rural buildings which are of architectural, historic, or social value and interest; (Housing Policy 11);
c) Previously developed land¹ which contains a significant amount of building; where the continued use is redundant; where redevelopment would reduce the impact of the

current situation on the landscape or the wider environment; and where the development proposed would result in improvements to the landscape or wider environment;
d) The replacement of existing rural dwellings; (Housing Policies 12, 13 and 14);
e) Location-dependant development in connection with the working of minerals or the provision of necessary services;
f) Building and engineering operations which are essential for the conduct of agriculture or forestry;
g) Development recognised to be of overriding national need in land use planning terms and for which there is no reasonable and acceptable alternative; and
h) Buildings or works required for interpretation of the countryside, its wildlife or heritage.

## 4.3 Environment Policy 15

Where the Department is satisfied that there is agricultural or horticultural need for a new building (including a dwelling), sufficient to outweigh the general policy against development in the countryside, and that the impact of this development including buildings, accesses, servicing etc. is acceptable, such development must be sited as close as is practically possible to existing building groups and be appropriate in terms of scale, materials, colour, siting and form to ensure that all new developments are sympathetic to the landscape and built environment of which they will form a part.

Only in exceptional circumstances will buildings be permitted in exposed or isolated areas or close to public highways and in all such cases will be subject to appropriate landscaping. The nature and materials of construction must also be appropriate to the purposes for which it is intended.

Where new agricultural buildings are proposed next to or close to existing residential properties, care must be taken to ensure that there is no unacceptable adverse impact through any activity, although it must be borne in mind that many farming activities require buildings which are best sited, in landscape terms, close to existing building groups in the rural landscape.

#### 5.0 Consultations

5.1 Highways Division do not oppose as it has no adverse traffic management, parking or road safety implications.

#### 5.2 Santon Commissioners has not commented

5.3 The Agricultural Advisor of the Department of Environment, Food and Agriculture has indicated that the extension of the building is agriculturally justified and offers many attractions to the business.

#### 6.0 Assessment

6.1 The application seeks approval for the erection of an extension to the gable end elevation of the agricultural building. The main issues to consider in the assessment of the current application are whether the extension is agriculturally justified, whether the siting and design are acceptable and whether the proposal would have a harmful impact upon the locality in general.
6.2 Ballachrink Farm is a working dairy farm, the building is proposed to rear heifers for the dairy herd. The Agricultural Advisor has carried out an assessment of the agricultural business and has indicated that the extension to the building is agriculturally justified.
6.3 In terms of siting, the proposed extension would be off an existing agricultural building which is sited to the rear of the farmyard furthest from the highway. The existing agricultural building is not highly visible from the main public thoroughfares. The extension would be finished to match the existing and the view of the whole building

would not be visible from the highway as this would be screened by a number of the other buildings on site. The proposed extension would respect the existing building in terms of size and design and would be constructed of appropriate materials for its purpose. Given its siting and design it is considered that the proposal would not have an adverse impact upon the character and appearance of the locality in general.
6.4 The proposed extension would be adjacent to the existing farm group and would not be in an exposed or isolated area or close to the public highway. Given that the extension would be within the existing building group it is considered that the proposal would be acceptable in landscape terms.
6.5 For the above reasons the application is considered to be acceptable and is recommended for approval.

## 7.0 Party Status

7.1 The local authority, Santon Commissioners is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
7.2 The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
7.3 The Department of Environment, Food and Agriculture is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (6) (a), considered an "interested person" and as such should be afforded party status.
