In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to **APPROVE** a planning application by Mr Paul Leneghan, Ref 13/00671/B, for the erection of a replacement porch, installation of replacement windows and creation of an additional window to side elevation of dwelling at Pinfold Cottage Pinfold Hill Laxey Isle Of Man IM4 7HN subject to compliance with the following condition(s):

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. The development hereby permitted shall not be carried out except in full accordance with the following plans: site location plan, block plan, and Drawing Numbers 1205.1 (survey) and 1205.2 (proposed) received on 05 June 2013.

## Officer's Report

### The Application Site

1. The application site is the curtilage of Pinfold Cottage, Pinfold Hill, Laxey. It is a traditional Manx rendered cottage situated next to the bend at the bottom of Pinfold Hill. Within the small grounds of the cottage is a holiday cottage, garage and holiday accommodation. There are neighbouring dwellings to either side and the site has a frontage with Pinfold Hill from which it is accessed.

### The Proposal

2. The application seeks planning consent for a front extension to replace the existing porch, the installation of replacement UPVC windows in the front elevation and the insertion of a new window in the north east side gable.

### Planning History

3. 10/01135/C – consent granted in 2010 for additional use of ancillary accommodation over garage for tourist use.

4. 09/00903/B – consent granted in 2009 for Erection of a two storey extension to provide holiday accommodation and a water wheel.

5. 08/01958/B – consent granted in 2008 for demolition of outbuilding and erection of replacement dwelling to provide tourist accommodation (comprising amendments to PA 07/01484/B).

6. 07/01486/B – consent granted in 2007 for demolition of existing garage and erection of a replacement garage with ancillary accommodation above and alterations to garden to increase parking provision and formation of a turning area.

7. 07/01484/B – consent granted in 2007 for demolition of outbuilding and erection of replacement building to provide tourist accommodation.

## Planning Policy

11. The site is on the boundary but just inside the Laxey and Lonan Area Plan 2005. It is recognised as being within predominantly residential use.
12. General Policy 2 of the Isle of Man Strategic Plan 2007 is relevant:
'Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:
(a) is in accordance with the design brief in the Area Plan where there is such a brief;
(b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;
(c) does not affect adversely the character of the surrounding landscape or townscape;
(d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses;
(e) does not affect adversely public views of the sea;
(f) incorporates where possible existing topography and landscape features, particularly trees and sod banks;
(g) does not affect adversely the amenity of local residents or the character of the locality;
(h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space;
(i) does not have an unacceptable effect on road safety or traffic flows on the local highways;
(j) can be provided with all necessary services;
(k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan;
(I) is not on contaminated land or subject to unreasonable risk of erosion or flooding;
(m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and
(n) is designed having due regard to best practice in reducing energy consumption.'

### Representations

13. Lonan Parish Commissioners - recommend approval, subject to the approval of the Department of Infrastructure's planning committee.
14. Highways Division - no objection.

### Assessment

15. The proposal comprises three main elements. The first is to replace the front conservatory with a more permanent extension. The extension would be slightly larger than the existing conservatory, but its form, scale and materials would be in keeping with the cottage and arguably a visual improvement. The second element is the replacement of the first floor timber windows in the front elevation with UPVC windows. The design and style of the windows is similar to the existing and the use of UPVC is considered acceptable,

particularly given that the adjacent holiday cottage also has UPVC windows. The third element is the insertion of a ground floor window in the side gable. The style of the window is similar to the existing openings and would be in keeping with the cottage. Overall, it is felt that the proposals would be in keeping with the cottage and that the character and appearance of the area would not be harmed.
16. It is considered that the proposals raise no neighbour amenity concerns.

## Recommendation

17. It is recommended that consent is approved.

### Party Status

18. The Local Authority, Lonan Parish Commissioners, is by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5)(d) granted Interested Party Status.
19. The Highways Division is part of the Department of Infrastructure and is not an Interested Party.
