In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Mr Douglas \& Mrs Jean Corlett, Ref 13/00599/B, for the installation of replacement conservatory roof at 38 Seafield Crescent Onchan Isle Of Man IM3 3BZ subject to compliance with the following condition(s):

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
2. The development hereby permitted shall not be carried out except in full accordance with Drawing Number 2013.17 01, received 20th May 2013.

This decision was made by a Senior Planning Officer in accordance with the authority delegated to them. This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

## Officer's Report

### 1.0 The Application Site

1.1 The application site is 38 Seafield Crescent, Onchan. Number 38 is a two-storey semi-detached dwelling situated within a residential area to the north of Onchan. A ground-mounted electricity sub-station is located outside number 34, two doors down from the application site.

1.2 Number 38 sits on the northeast of Seafield Crescent with a conservatory to the rear of the dwelling, making it northeast-facing but not visible from the public highway.

### 2.0 The Proposal

2.1 This planning application seeks approval for the replacement of the existing polycarbonate conservatory roof with a lightweight, Decralite tiled roof with new gutters, fascias and lead flashings.

2.2 The plans show that the tiles would match those of the existing dwelling in style/shape and colour. No other alterations are proposed.

### 3.0 Planning History

3.1 The only previous planning application on this site of relevance is that relating to the erection of the conservatory itself (reference 95/00043), which was granted in 1995.

### 4.0 Planning Policy

4.1 In terms of local plan policy, the application site is within an area zoned as Predominantly Residential in the Onchan Local Plan, Map No. 1 – it is on this map that the aforementioned electricity sub-station is identified.

4.2 In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains one policy that is considered specifically material to the assessment of this planning application:

General Policy 2 states: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:

(b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;
(c) does not affect adversely the character of the surrounding landscape or townscape, and
(g) does not affect adversely the amenity of local residents or the character of the locality."

## 5.0 Representations

5.1 Onchan District Commissioners recommend the application be approved.

#### 6.0 Assessment

6.1 A replacement conservatory roof is sought for approval; no alteration to the footprint of number 38 would result. In assessing the proposal, the primary considerations are the extent to which, if implemented, it would have an impact on the residential amenity of the area and the appropriateness of the materials proposed.
6.2 Given that the proposed replacement conservatory roof would, if implemented, result in tiles to match the main dwellinghouse, it is considered that the proposal would enhance the appearance of number 38. Although the conservatory roof currently in situ is not considered to be unattractive or inappropriate in design terms, its replacement with matching tiling will give the dwelling a more uniform appearance and help to more successfully integrate the conservatory within the wider streetscene.
6.3 As a result, it is concluded that the planning application does not conflict with General Policy 2 of the Isle of Man Strategic Plan 2007.
6.4 The presence of the electricity substation, which is not adjacent to the site, is noted. Its presence is not likely to have a significant impact on the application site. As a result, it is concluded that the planning application does not conflict with the Onchan Local Plan.

#### 7.0 Recommendation

7.1 It is recommended that the planning application be permitted.

#### 8.0 Party Status

8.1 The local authority, Onchan District Commissioners, is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5)(d), considered an "interested person" and as such should be afforded party status.
