### Town and Country Planning Act 1999

#### The Town and Country Planning (Development Procedure) Order 2005

In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to **APPROVE** a planning application by Mr Warren J Hancox, Ref 13/00520/B, for the Door and window alterations at Athol House Athol Street Port St. Mary Isle Of Man IM9 5DS subject to compliance with the following condition(s):

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

**Reason:** To accord with the provisions of Section 13(1) of the Town and Country Planning (Development Procedure) Order 2005.

2. This approval relates to the replacement and alterations of the existing windows as shown and described in drawing reference 16.1.13 received on 30th April, 2013 and the development must be undertaken in accordance with those drawings unless otherwise approved by the Planning Authority.

This decision was made by a Senior Planning Officer in accordance with the authority delegated to them. This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department's public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.

Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.

### Officer's Report

#### The Site

1.1 The property is the residential curtilage of an existing property situated on the eastern side of Athol Street. The property is a two storey building of traditional style and proportions with typical windows of vertical proportions on the first floor front elevation, fitted with plastic framed casement windows installed, and wider windows on the front ground floor elevation. The two windows either side of the left hand side door have dimensions of 1.35m by 1.9m and that on the right hand side of the right hand door 1.5m by 1.6m. These ground floor windows have fixed single lights and a large fixed light with two small top lights, respectively.

1.2 The side elevation which faces onto a pedestrian route from Athol Street to the Shore Road has a large timber window with dimensions of 2.4m by 2.2m and a concrete surround.

#### The Proposal

2.1 Proposed is the installation of uPVC sliding sash windows in the upper floor and sash look alike windows in the ground floor with side lights. The front elevation windows are to have surround mouldings fitted and the ground floor windows concrete cills.

2.2 Also proposed is the blocking up of the left hand door and the replacement of the right hand door with a plastic door with two upper vertical panels and a horizontal lower panel.

2.3 The side window is to be reduced in width to 650mm with a concrete surround.

#### Planning Policy And Status

3.1 The property lies within an area designated as Mixed Use on the Southern Area Plan and within a proposed Conservation Area. The conservation area will be progressed separate from the Area Plan.

3.2 As such, the most relevant policies to be applied to the property are those within Planning Circular 1/98 – replacement of windows with regard also to those policies which refer to development within Conservation Areas, albeit bearing in mind that the property is not yet within an adopted CA:

4.1 Planning permission was sought and granted to the change of use of commercial area to residential under PA 01/00564.

## Representations

5.1 Port St Mary Commissioners indicate that they do not oppose the application.

### Assessment

6.1 The proposed windows will preserve the existing character of the building and the ground floor windows and detailing proposed will enhance the character of the property, in line with what would be expected within a Conservation Area.
6.2 It is considered that the proposal is acceptable.

### Party Status

7.1 The local authority, Port St. Mary Commissioners are, by virtue of the Town and Country Planning (Development Procedure) Order 2005 paragraph 6.4(d) interested parties and as such should be afforded party status to this application.
