## The Town And Country Planning Act 1999

### The Town And Country Planning (Development Procedure) Order 2005

Ms W Shearman
Cronk Aashen Farm
Barregarrow
Kirk Michael
IM6 1HQ

In pursuance of his powers under the above Act and Order, the Minister for Infrastructure does hereby **REFUSE** planning application 13/00496/C by Wendy Shearman for Siting of a static caravan (retrospective), Field 234211, Cronk Aashen Farm, Barregarrow, Kirk Michael, IM6 1HQ for the following reason(s):

1. The proposal is contrary to Environment Policy 1 and Environment Policy 2 of the Isle of Man Strategic Plan 2007 in that there is no overriding national need for the caravan in this position and its siting in this position harms the quality of the landscape.

2. The proposal is contrary to General Policy 3 of the Isle of Man Strategic Plan 2007 in that there is a clear presumption against new development in the countryside and the use of land for residential purposes does not qualify as one of the exceptions to this policy.

Date of issue: 28 October 2013

By Order of the Minister

Note 1: A copy of the report of the appointed person is appended hereto.

Note 2: This refusal shall be taken to relate to the retention of the caravan which is the subject of planning application 13/00496/C for both permanent and temporary use at Field 234211, Cronk Aashen Farm, Barregarrow, Kirk Michael, IM6 1HQ.
