## Officer’s Report

### 1.0 Description

1.1 Planning Application 23/00388/B was APPROVED at APPEAL under AP24/0052 on 13.08.2025 for: Construction of seven detached houses and associated infrastructure

1.2 This approval is subject to 17 conditions, some of which require the submission of additional information prior to the commencement of works.

1.3 This report is specific to conditions No. 14, which the applicants are seeking to satisfy. The specific wording of the condition is as follows:

Within three (3) months of this approval becoming final, details of a Management Plan of the surface water drainage system proposed part of the approved development, and which would not be adopted by Manx Utilities Drainage shall be submitted to and approved in writing by the Department. The Plan shall include details of ownership and long-term maintenance responsibilities of the surface water infrastructure (including any land drainage) identified on Drawing No. 22/3178/P/04 Rev J. The plan shall provide details on the frequency and method of emptying of catchpit labelled B and situated at the northeast corner of Plot 3 on the site Plan. The development shall not be carried out other than in accordance with the approved management Plan and shall be maintained as such thereafter.

Reason: To ensure that the unadopted surface water scheme for the development is maintained to avoid impacts on the occupants of the new dwellings and neighbouring properties.

### 2.0 Proposal

2.1 The applicant's agent has submitted an application form on 04.11.2025 along with:

- Surface water drainage plan
- Management Plan

### 3.0 Consultation and Assessment

3.1 Manx Utilities was consulted for advice. Their advice was received on 21.11.2025. The comment states that management of the drainage can be difficult.

3.2 The condition request the following and they have been provided with the management plan:

- details of ownership
- long-term maintenance responsibilities
- details on the frequency and method of emptying of catchpit labelled B and situated at the northeast corner of Plot 3 on the site Plan.
- Therefore, the plan is considered to meet the requirements within the conditions

3.3 While Manx Utilities has acknowledged the challenge of this management plan, it is considered that since this management plan is still feasible. It would achieve the desired outcome as long it is executed accordingly.

### 4.0 Recommendation

4.1 In this instance of the submitted documents and it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning conditions 14 of application 25/90430/B and AP24/0052 , under the understanding that the development shall not be carried out unless in accordance with the approved details.
