TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure) Order 2019

In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Culture Vannin, Ref 25/90999/B, for the Alterations and erection of replacement rear extension and rear store and garden room, installation of rooflights, solar panels, air source heat pump, replacement of garage door with a window, creation of seating area, access ramp and bin store, and replacement of front windows and door. at Fairfield House Main Road St Johns Isle Of Man IM4 3NA .

Any conditions or notes which apply to the approval are set out below. This approval is subject to compliance with any conditions listed and may not be implemented until it becomes final (see guidance notes).

- 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.

Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.

- 2. The materials to be used in the construction and finishing of the development hereby approved shall be as described on Drawing Numbers 10-02 and 10-03 unless alternatives are first submitted to and approved in writing by the Department. Development shall be carried out in accordance with the approved details. Reason: In the interests of the character and appearance of the host building and wider area.
- 3. The Air Source Heat Pump to be installed upon the site shall be the Ecodan R32 model shown and described on the approved Information Sheet unless details of any alternative is first submitted to and approved in writing by the Department. Installation shall be carried out in accordance with the approved details.

Reason: To allow for appraisal of the effects of an ASHP upon the living conditions of near neighbours.

- 4. Should the current use of the building cease and it revert to a private dwellinghouse, the seating and display panels hereby approved on the frontage shall be removed and a parking space shall be reinstated to the satisfaction of the Highway Authority.

Reason: To provide off road parking for future residents in the interest of highway safety and living conditions.

- o 10-01, Existing Floor Plans, Sections and Elevations
- o 10-02, Revision 1 Proposed Site and Floor Plans, Sections and Elevations
- o 10-03, Proposed Garden Room and External Store
- o Air Source Heat Pump Information Sheet (Ecodan R32)

This decision has been made for the following reasons(s) The proposed development would cause no harm to the character and appearance of the site or wider area and it would preserve the setting of the nearby Registered Buildings and Ancient Monument. It would cause no significant harm to the living conditions of neighbouring occupiers to the west or south; and the loss of one off-road parking space would have no detrimental effect upon highway safety. The benefits of improving public access to the building would

- outweigh the loss of the parking space and the conflict with Transport Policy 7 of the Strategic Plan. The proposal would otherwise comply with the Development Plan and with relevant legislation.

Guidance Note

This decision was made by a Principal Planner in accordance with the authority delegated to them.

This decision refers only to that applied for under the Town and Country Planning Act 1999 and its subordinate legislation.

Implementation A determination to grant planning approval does not have effect —

-  if an appeal is submitted until the appeal is determined or withdrawn; or
-  if no appeal is submitted, but there are potential appellants in addition to the applicant, until the time within which an appeal may be submitted has expired (21 days from the date of this notice).

Development must be carried out in accordance with the approved plans and any attached conditions (irrespective of any changes that may separately be requested at the Building Control stage or by any other Statutory Authority). This approval does not remove the need to also comply with any other relevant legislation.

Any conditions requiring certain works, submissions etc. prior to commencement of development must be fulfilled prior to work starting on site. Failure to adhere to this approval and meet the requirements of all conditions may invalidate this approval or result in formal enforcement action.

Appeal Any appeal can only be made by a person who has been accorded rights to do so, must be in writing, include the appropriate fee and be submitted to the Department within 21 days of the date of this Notice.
